{"id":3191,"date":"2010-12-09T03:59:32","date_gmt":"2010-12-09T08:59:32","guid":{"rendered":"http:\/\/akunq.net\/tr\/?p=3191"},"modified":"2010-12-09T03:59:32","modified_gmt":"2010-12-09T08:59:32","slug":"yabancilara-mulk-yasasi-yilsonuna-cikiyor","status":"publish","type":"post","link":"https:\/\/akunq.net\/turkish\/2010\/12\/09\/yabancilara-mulk-yasasi-yilsonuna-cikiyor\/","title":{"rendered":"Yabanc\u0131lara m\u00fclk yasas\u0131 y\u0131lsonuna \u00e7\u0131k\u0131yor"},"content":{"rendered":"<p style=\"text-align: justify\"><strong>Yabanc\u0131lar\u0131n T\u00fcrkiye\u2019den m\u00fclk edinimi konusunda kapsaml\u0131 bir \u00e7al\u0131\u015fma y\u00fcr\u00fcten Bay\u0131nd\u0131rl\u0131k ve \u0130skan Bakanl\u0131\u011f\u0131\u2019n\u0131n tasar\u0131s\u0131 yasala\u015f\u0131rsa T\u00fcrkiye\u2019de yabanc\u0131lar kolayca gayrimenkul edinebilecek.<\/strong><\/p>\n<p style=\"text-align: justify\">Tebern\u00fc\u015f Kire\u00e7ci\u2019nin haberi<\/p>\n<p style=\"text-align: justify\">T\u00fcrkiye\u2019nin g\u00fcndemini uzun bir s\u00fcreden beri i\u015fgal eden yabanc\u0131lara m\u00fclk sat\u0131\u015f\u0131nda sona geliniyor. 2B Yasas\u0131\u2019n\u0131n ard\u0131ndan, yabanc\u0131lar\u0131n T\u00fcrkiye\u2019de gayrimenkul sahibi edinmesini kolayla\u015ft\u0131ran yasa i\u00e7in de d\u00fc\u011fmeye bas\u0131ld\u0131.<\/p>\n<p style=\"text-align: justify\">Bay\u0131nd\u0131rl\u0131k ve \u0130skan Bakanl\u0131\u011f\u0131 taraf\u0131ndan haz\u0131rlanan tasar\u0131, yasala\u015f\u0131rsa T\u00fcrkiye yabanc\u0131lar\u0131n d\u00fcnyada en kolay gayrimenkul sahibi olabildi\u011fi \u00fclkelerden biri haline gelecek.<\/p>\n<p style=\"text-align: justify\">Tasar\u0131ya g\u00f6re Yunanistan ve \u0130srail de dahil d\u00fcnya genelindeki t\u00fcm \u00fclkelerin vatanda\u015flar\u0131 sadece pasaport ve foto\u011fraf ile T\u00fcrkiye\u2019de ev sahibi olabilecek.<\/p>\n<p style=\"text-align: justify\">Ev ve arsa sat\u0131l\u0131rken, al\u0131c\u0131n\u0131n pasaportunu ta\u015f\u0131d\u0131\u011f\u0131 \u00fclke ile T\u00fcrkiye\u2019nin m\u00fctekabiliyet yani kar\u015f\u0131kl\u0131l\u0131k anla\u015fmas\u0131n\u0131n olup olmad\u0131\u011f\u0131n\u0131 bak\u0131lmayacak.<\/p>\n<p style=\"text-align: justify\"><strong>Arsa ve arazide s\u0131n\u0131rlama var<\/strong><\/p>\n<p style=\"text-align: justify\">Yasadaki tek s\u0131n\u0131rlama konusunu ise arsa ve araziler olu\u015fturuyor. Arsa ve arazi yat\u0131r\u0131mlar\u0131 \u0130srail ve Yunan vatanda\u015flar\u0131na yasaklan\u0131rken bunun d\u0131\u015f\u0131ndaki \u00fclkelerin vatanda\u015flar\u0131 99 bin metrekareye kadar arsa yada arazi sahibi olabilecek. \u0130ran, Suriye, Suudi Arabistan ile K\u00f6rfez \u00fclkelerinin vatanda\u015flar\u0131na ise arsa ve arazi al\u0131m\u0131nda s\u0131n\u0131r tan\u0131mayacak. Bu \u00fclkelerin vatanda\u015flar\u0131 istedi\u011fi geni\u015flikte arsa yada arazi sat\u0131n alabilecek.<\/p>\n<p style=\"text-align: justify\">Daha \u00f6nce g\u00fcndeme gelen yabanc\u0131lar\u0131n T\u00fcrkiye\u2019de sat\u0131n ald\u0131klar\u0131 gayrimenkulde intifa yani kullan\u0131m hakk\u0131n\u0131 99 y\u0131l s\u00fcre ile s\u0131n\u0131rlama ise rafa kald\u0131r\u0131ld\u0131. T\u00fcrkiye\u2019de gayrimenkul sahibi olan yabanc\u0131lar s\u00fcresiz olarak kullan\u0131m hakk\u0131na sahip olacak.<\/p>\n<p style=\"text-align: justify\"><strong>Askerden g\u00f6r\u00fc\u015f s\u00fcresi 1 ay<\/strong><\/p>\n<p style=\"text-align: justify\">Askeri alanlara kom\u015fu olan arsa ve arazilerde sat\u0131\u015f i\u015fleminin gecikmesine tasar\u0131da \u00e7\u00f6z\u00fcm bulundu. Genel Kurmay askeri alanlara kom\u015fu arsa ve arazilerde kom\u015fu alanlarda sat\u0131lamayacak parseller i\u00e7in harita haz\u0131rlayacak. Harita haz\u0131rlan\u0131ncaya kadar, tasar\u0131ya konulan ge\u00e7ici madde ile askeri makamlardan 1 ay i\u00e7inde olumlu yada olumsuz g\u00f6r\u00fc\u015f bildirmesi zorunlu olacak.<\/p>\n<p style=\"text-align: justify\"><strong>Bakanl\u0131k haz\u0131rlad\u0131<\/strong><\/p>\n<p style=\"text-align: justify\">Tasar\u0131y\u0131 Ba\u015fbakanl\u0131\u011f\u0131n talimat\u0131 \u00fczerine Bay\u0131nd\u0131rl\u0131k Bakanl\u0131\u011f\u0131 haz\u0131rlad\u0131. Tasar\u0131yla ilgili kamu kurum ve kurulu\u015flar\u0131 ile \u00f6zel sekt\u00f6rden tasar\u0131 ile ilgili g\u00f6r\u00fc\u015f al\u0131nd\u0131. Gelen g\u00f6r\u00fc\u015flere g\u00f6re d\u00fczenlemeler yap\u0131lacak.<\/p>\n<p style=\"text-align: justify\">Ard\u0131ndan TBMM\u2019ye g\u00f6nderilmek \u00fczere Ba\u015fbakanl\u0131\u011f\u0131 iletilecek.<\/p>\n<p style=\"text-align: justify\"><strong>Y\u0131lsonuna kadar yeti\u015febilir<\/strong><\/p>\n<p style=\"text-align: justify\">Ba\u015fta Arap \u00fclkeleri olmak \u00fczere d\u00fcnya genelinde 100 binlerce yabanc\u0131n\u0131n T\u00fcrkiye\u2019de gayrimenkul edinmek istemesi h\u00fck\u00fcmeti harekete ge\u00e7irdi. Buradan gelecek para ile cari a\u00e7\u0131\u011f\u0131n kapat\u0131lmas\u0131 planlan\u0131yor. \u00d6ncelikli g\u00fcndemi 2B Yasas\u0131 olan h\u00fck\u00fcmet hemen ard\u0131ndan yabanc\u0131larla ilgili yasa i\u00e7in d\u00fc\u011fmeye basacak.<\/p>\n<p style=\"text-align: justify\"><strong>M\u00fctekabiliyet:<\/strong><\/p>\n<p style=\"text-align: justify\">T\u00fcrkiye\u2019de yabanc\u0131lara ta\u015f\u0131nmaz mal sat\u0131\u015f\u0131nda m\u00fctekabiliyet (kar\u015f\u0131l\u0131kl\u0131l\u0131k) ilkesi uygulan\u0131yor. Bu ilke, en az iki devlet aras\u0131nda uygulanan ve her birinin \u00fclkesinde di\u011ferinin vatanda\u015flar\u0131na ayn\u0131 nitelikteki haklar\u0131 kar\u015f\u0131l\u0131kl\u0131 olarak tan\u0131malar\u0131n\u0131 \u00f6ng\u00f6r\u00fcyor.<\/p>\n<p style=\"text-align: justify\">Bir yabanc\u0131n\u0131n T\u00fcrkiye\u2019de ta\u015f\u0131nmaz sat\u0131n alma hakk\u0131ndan yararlanabilmesi i\u00e7in T\u00fcrkiye Cumhuriyeti vatanda\u015flar\u0131n\u0131n da o yabanc\u0131n\u0131n \u00fclkesinde ayn\u0131 haktan yararlanabilmesi gerekiyor.<\/p>\n<p style=\"text-align: justify\"><strong>Kar\u015f\u0131l\u0131kl\u0131l\u0131k anla\u015fmam\u0131z olan \u00fclkeler<\/strong><\/p>\n<p style=\"text-align: justify\">Almanya, ABD, Andorra, Arjantin, Avustralya, Avusturya, Bahamalar, Banglade\u015f, Barbados, Bel\u00e7ika, Belize, Benin, Bolivya, Bosna-Hersek, Botswana, Brezilya, Danimarka, Dominik, Ekvador, El Salvador, Estonya, Fildi\u015fi Sahili, Filipinler, Finlandiya, Fransa, Gabon, Gana, Gine, Grenada, Guatemala, Guyana, G\u00fcney Afrika Cumhuriyeti, Haiti, H\u0131rvatistan, Hollanda, Honduras, \u0130ngiltere, \u0130rlanda, \u0130spanya, \u0130sve\u00e7, \u0130svi\u00e7re, \u0130talya, Jamaika, Japonya, Kamerun, Kanada, KKTC, Kolombiya,G\u00fcney Kore, Kosta Rika,Letonya, Lihten\u015ftayn, Litvanya, L\u00fcksemburg, Macaristan, Malawi, Malezya, Mali, Malta, Mauritius, Meksika, Monako, Moritanya, Mozambik, Nijerya, Nikaragua, Norve\u00e7, Orta Afrika Cumhuriyeti, Panama, Paraguay, Peru, Polonya, Portekiz, San Marino, Senegal, S\u0131rbistan, Singapur, Somali, Sri Lanka, Swaziland, \u015eili, Tanzanya, Uruguay, Venezuela, Yeni Zelanda, ve Ye\u015filburun Adalar\u0131.<\/p>\n<p style=\"text-align: justify\"><strong>Sadece bina edinebilenler<\/strong><\/p>\n<p style=\"text-align: justify\">Azerbaycan, Bahreyn, Belarus, \u00c7ad, \u00c7in, Fas, G\u00fcrcistan, \u0130ran (5 y\u0131l ikamet \u015fart\u0131 ve bakanl\u0131k izni ile), Kazakistan, Kenya, K\u0131rg\u0131zistan, Makedonya, M\u0131s\u0131r, Moldova, Namibya, \u00d6zbekistan, Romanya, Rusya Federasyonu, Slovenya, Tacikistan, T\u00fcrkmenistan, Uganda, Ukrayna ve \u00dcrd\u00fcn.<\/p>\n<p style=\"text-align: justify\"><strong>Borsa \u00e7\u0131kartmas\u0131 milyonlar getirdi<\/strong><\/p>\n<p style=\"text-align: justify\">Sermaye Piyasas\u0131 Kurulu (SPK)\u2019nun yay\u0131nlad\u0131\u011f\u0131 rapor, bu y\u0131l halka arz edilen 5 gayrimenkul yat\u0131r\u0131m ortakl\u0131\u011f\u0131 (GYO) \u015firketi ile sekt\u00f6re sermaye piyasalar\u0131ndan toplam 609 milyon 231 bin TL kaynak aktar\u0131m\u0131 sa\u011fland\u0131\u011f\u0131n\u0131 ortaya \u00e7\u0131kard\u0131.<\/p>\n<p style=\"text-align: justify\">Bunlara ek olarak d\u00f6rt GYO\u2019da halka arz i\u00e7in SPK\u2019ya ba\u015fvuruda bulunurken halen \u0130MKB\u2019de i\u015flem g\u00f6ren 19 GYO\u2019nun toplam piyasa de\u011feri ise 5 milyar 556 milyon 349 bin TL\u2019yi buluyor.<\/p>\n<p style=\"text-align: justify\">Bu \u015firketlerin portf\u00f6y de\u011feri ise 8 milyar 235 milyon 541 bin TL.<\/p>\n<p style=\"text-align: justify\">Bu y\u0131l TSKB, \u0130dealist, Reysa\u015f, Mart\u0131 ve Torunlar GYO olmak \u00fczere 5 \u015firket halka arz edilirken 2010\u2019da yap\u0131lan arzlara bak\u0131ld\u0131\u011f\u0131nda piyasa de\u011feri olarak toplam sekt\u00f6r b\u00fcy\u00fckl\u00fc\u011f\u00fcn\u00fcn y\u00fczde 36.70\u2019inin ve portf\u00f6y b\u00fcy\u00fckl\u00fc\u011f\u00fc olarak da sekt\u00f6r\u00fcn portf\u00f6y b\u00fcy\u00fckl\u00fc\u011f\u00fcn\u00fcn y\u00fczde 41.18\u2019i bu y\u0131l yap\u0131lan halka arzlardan olu\u015ftu.<\/p>\n<p style=\"text-align: justify\">SPK raporunda 2010 y\u0131l\u0131ndaki halka arzlarla GYO sekt\u00f6r\u00fcn\u00fcn b\u00fcy\u00fckl\u00fcklerinin yakla\u015f\u0131k olarak 2 kat\u0131na \u00e7\u0131kt\u0131\u011f\u0131n\u0131 belirtirken, \u201cBu durumun Kas\u0131m ay\u0131nda halka arz\u0131 planlanan Emlak GYO ile dahada belirginle\u015fmesi ve GYO\u2019lar a\u00e7\u0131s\u0131ndan bu y\u0131l\u0131n halka arz seferberli\u011fi niteli\u011fi ta\u015f\u0131yaca\u011f\u0131\u201d dile getirildi.<\/p>\n<p style=\"text-align: justify\"><strong>4 \u015firket s\u0131rada bekliyor<\/strong><\/p>\n<p style=\"text-align: justify\">Emlak Konut, Akfen ve Albayrak GYO ile B\u00fcy\u00fckhanl\u0131 Gayrimenkul Ortakl\u0131\u011f\u0131 da halka arz i\u00e7in SPK\u2019ya ba\u015fvurmu\u015f durumda. S\u00f6z konusu ba\u015fvurular\u0131n sonu\u00e7land\u0131r\u0131lmas\u0131yla 4 GYO\u2019nun halka arz\u0131ndan gayrimenkul sekt\u00f6r\u00fcne sermaye piyasalar\u0131ndan tahmini 1 milyar 170 milyon TL kaynak aktar\u0131m\u0131n\u0131n sa\u011flanmas\u0131 bekleniyor.<\/p>\n<p style=\"text-align: justify\">2010 y\u0131l\u0131nda yap\u0131lan halka arzlarla GYO sekt\u00f6r\u00fc, piyasa de\u011feri ve porf\u00f6y b\u00fcy\u00fckl\u00fc\u011f\u00fc olarak 2010 y\u0131l\u0131 ba\u015f\u0131ndaki b\u00fcy\u00fckl\u00fc\u011f\u00fcn\u00fc yakla\u015f\u0131k iki kat\u0131na \u00e7\u0131kard\u0131. Muhtemel arzlarla birlikte de y\u0131lba\u015f\u0131ndaki b\u00fcy\u00fckl\u00fc\u011f\u00fcn 3 kat\u0131na \u00e7\u0131kmas\u0131n\u0131n beklendi\u011fi belirtilen SPK raporunda, \u201c2010 y\u0131l\u0131ndaki halka arz\u0131n \u00f6n\u00fcm\u00fczdeki y\u0131llarda da artarak devam etmesi beklenmektedir.<\/p>\n<p style=\"text-align: justify\">B\u00fcy\u00fck \u00e7apl\u0131 GYO halka arzlar\u0131 yoluyla, \u00fclkemizde h\u0131zla geli\u015fen gayrimenkul sekt\u00f6r\u00fcne geleneksel finansman y\u00f6ntemlerine bir alternatif olarak sermaye piyasalar\u0131 yoluyla ucuz ve uzun vadeli finansman olana\u011f\u0131 sa\u011flanmas\u0131 hedeflenmektedir\u201d denildi.<\/p>\n<p style=\"text-align: justify\"><strong>B\u00fcrokrasi azalt\u0131ld\u0131<\/strong><\/p>\n<p style=\"text-align: justify\">Bu arada SPK yapt\u0131\u011f\u0131 d\u00fczenleme ile bu y\u0131l\u0131n ba\u015f\u0131nda GYO\u2019lar\u0131n minimum halka a\u00e7\u0131lma oranlar\u0131n\u0131 y\u00fczde 49\u2019dan y\u00fczde 25\u2019e d\u00fc\u015f\u00fcrerek halka arzlar\u0131 te\u015fvik edilmi\u015fti.<\/p>\n<p style=\"text-align: justify\">\u00d6te yandan Kurul yapt\u0131\u011f\u0131 ba\u015fka bir d\u00fczenleme ile GYO\u2019lar\u0131n halka arz\u0131 i\u00e7in sermayeye ba\u011fl\u0131 s\u00fcre verilmesi uygulamas\u0131ndan vazge\u00e7ilerek, ortakl\u0131klar\u0131n, kurulu\u015flar\u0131n\u0131 takip eden 3 ay i\u00e7inde \u00e7\u0131kar\u0131lm\u0131\u015f sermayelerinin asgari y\u00fczde 25\u2019ini temsil eden paylar\u0131n\u0131n halka arz edilmesi zorunlulu\u011funu getirmi\u015fti.<\/p>\n<p style=\"text-align: justify\">\u0130MKB\u2019de i\u015flem g\u00f6ren GYO\u2019lar: Akmerkez, Alarko, Atakule, Do\u011fu\u015f, \u0130\u015f, Nurol, \u00d6zderici, Pera, Sa\u011flam, Sinpa\u015f, Vak\u0131f, Y&amp;Y, Yap\u0131 Kredi Koray, EGS, TSKB, \u0130dealist, Reysa\u015f, Mart\u0131, Torunlar.<\/p>\n<p style=\"text-align: justify\"><strong>\u2018Kentsel d\u00f6n\u00fc\u015f\u00fcm alg\u0131s\u0131 de\u011fi\u015fmeli\u2019<\/strong><\/p>\n<p style=\"text-align: justify\">\u0130stanbul\u2019da kentsel d\u00f6n\u00fc\u015f\u00fcm dendi\u011finde gecekondu ve niteliksiz konutlar\u0131n yerine l\u00fcks konutlar\u0131n in\u015fa edilmesinin alg\u0131lad\u0131\u011f\u0131n\u0131 belirten Emlakchi Gayrimenkul Pazarlama Y\u00f6netim Kurulu Ba\u015fkan\u0131 Bilge \u00d6zdemir, l\u00fcks konutlarla rant\u0131n e\u015f de\u011fer g\u00f6r\u00fcld\u00fc\u011f\u00fcn\u00fc kaydetti.<\/p>\n<p style=\"text-align: justify\">Bu anlay\u0131\u015f\u0131n de\u011fi\u015ftirilerek kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn \u00e7ok daha geni\u015f bir anlam\u0131 oldu\u011funun anlat\u0131lmas\u0131 gerekti\u011fini ifade eden \u00d6zdemir, \u201cD\u00f6n\u00fc\u015f\u00fcm sadece konutlar\u0131 kapsamaz. Sanayi, ticaret, teknoloji parklar\u0131, kamu hizmeti alanlar\u0131, rekreasyon ve her t\u00fcrl\u00fc sosyal donat\u0131 alanlar\u0131n\u0131 olu\u015fturmak da kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn alan\u0131na girer. Ayn\u0131 zamanda kentin eskiyen k\u0131s\u0131mlar\u0131n\u0131n yeniden in\u015fa edilmesi, dokusunun korunmas\u0131 ve depreme kar\u015f\u0131 tedbir almakta kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn ilgi alan\u0131na girer\u201d diye konu\u015fuyor.<\/p>\n<p style=\"text-align: justify\"><strong>\u2018\u0130ki b\u00f6lgeli olmal\u0131\u2019<\/strong><\/p>\n<p style=\"text-align: justify\">\u0130stanbul\u2019da kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn iki farkl\u0131 uygulama alan\u0131 bulundu\u011funu vurgulayan \u00d6zdemir, istanbul\u2019u tarihi yar\u0131mada modern mimariye uygun olan k\u0131s\u0131m diye ikiye ay\u0131r\u0131yor.<\/p>\n<p style=\"text-align: justify\">Kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn en sorunlu ve sosyal y\u00f6n\u00fc a\u011f\u0131r basan k\u0131sm\u0131n\u0131n eski \u0130stanbul kesiminde olaca\u011f\u0131n\u0131 belirten \u00d6zdemir, \u201cBurada halk de\u011fi\u015fimin bir par\u00e7as\u0131 olmal\u0131 ve sosyal rahats\u0131zl\u0131klara meydan verilmemeli.
