Bu topraklarda ya\u015fayan insanlar onun hakk\u0131nda ne bilir? Bir yabanc\u0131 g\u00f6z\u00fcyle K. Belki en fazla Gomidas\u2019\u0131n ad\u0131 s\u00f6ylenir, ama ikinci bir isim zor \u00e7\u0131kar.<\/p>\n<p style=\"text-align: justify\">Krikor Zohrab, 24 Nisan 1915 listesinde yoktur, ama kaderi onlar\u0131nkinden farkl\u0131 olmam\u0131\u015ft\u0131r. Gazeteciler Cemiyetinin \u015fehit gazeteciler listesinde art\u0131k Krikor Zohrab ve Diran Kelekyan isimleri de yer almaktad\u0131r.<\/p>\n<p style=\"text-align: justify\">Krikor Zohrab\u2019\u0131n kimli\u011finden Ermeni kelimesini \u00e7\u0131kar\u0131rsan\u0131z, ortaya bu co\u011frafyan\u0131n bir insan\u0131, bu \u00fclke i\u00e7in \u00e7al\u0131\u015fan bir ayd\u0131n ki\u015filik kar\u015f\u0131m\u0131za \u00e7\u0131kar. Elbette Krikor Zohrab bir Ermenidir ve bu kimli\u011fi ile bu co\u011frafyaya b\u00fct\u00fcnle\u015fmi\u015ftir. Edebiyat\u00e7\u0131 y\u00f6n\u00fc ile bir Tevfik Fikret\u2019ten, siyasi kimli\u011fi ile bir Ahmet T\u00fcrk\u2019ten, hukuk\u00e7u kimli\u011fi ile bir Barolar Birli\u011fi ba\u015fkan\u0131ndan farkl\u0131 de\u011fildir. Tek fark\u0131 unutturulmas\u0131, yok say\u0131lmas\u0131 idi. Krikor Zohrab\u2019\u0131n giderek hakk\u0131 olan yeri alaca\u011f\u0131 g\u00fcnler uzak de\u011fil bence. Edebiyat ders kitaplar\u0131m\u0131zda Krikor Zohrab\u2019\u0131n bir hik\u00e2yesinin yer alabilmesi, onun edebi y\u00f6n\u00fcn\u00fcn ders konusu olmas\u0131 bana uzak bir ihtimal gibi gelmiyor.\u00a0\u00a0<\/p>\n<p style=\"text-align: justify\"><b>Krikor Zohrab yaln\u0131z edebiyat ve siyaset alanlar\u0131nda me\u015fhur de\u011fil o ayn\u0131 zamanda ba\u015far\u0131l\u0131 bir avukatt\u0131. Zohrab siyasi tutuklu ya da k\u0131rsallardan gelen Ermenilerin haklar\u0131n\u0131 savunmakla yetinmiyor, o en y\u00fcksek Ticaret Mahkemelerinde yabanc\u0131lar\u0131n haklar\u0131n\u0131 da savunuyordu. Hukuk alan\u0131nda K. Zohrab&#8217;\u0131n m\u00fccadelesi ne y\u00f6nde ilerliyordu? <\/b><\/p>\n<p style=\"text-align: justify\">Krikor Zohrab, d\u00f6neminin tan\u0131nm\u0131\u015f bir hukuk\u00e7usuydu. Hukuk alan\u0131nda yazd\u0131\u011f\u0131 kitab\u0131, makaleleri vard\u0131 ve \u0130stanbul\u2019da hukuk fak\u00fcltesinde Ceza Hukuku dersi veriyordu.<\/p>\n<p style=\"text-align: justify\">Zohrab\u2019\u0131n hukuk bilgisine h\u00e2kimiyeti toplum taraf\u0131ndan bilindi\u011fi gibi, mahkemelerin h\u00e2kimleri taraf\u0131ndan da kabul g\u00f6rm\u00fc\u015ft\u00fc. Kaybedilece\u011fini ba\u015ftan tespit etti\u011fi davalar\u0131 kabul etmez, buna kar\u015f\u0131l\u0131k ald\u0131\u011f\u0131 dava dosyalar\u0131n\u0131 da kazanmas\u0131 ile bilinirdi.\u00a0<\/p>\n<p style=\"text-align: justify\">\u00d6nce adaletten yanayd\u0131. Padi\u015fah ailesinden gelen davalara da girdi\u011fi gibi, grev yapan i\u015f\u00e7ilerin de davas\u0131n\u0131 \u00fcstlenir ve ba\u015far\u0131yla sonu\u00e7land\u0131r\u0131rd\u0131.\u00a0 Bir yanda, ge\u00e7imini sa\u011flamak i\u00e7in ald\u0131\u011f\u0131 davalara girerken, \u00f6te yanda dava masraflar\u0131 ve avukatl\u0131k \u00fccretini \u00f6deyemeyen, ancak hakl\u0131 olduklar\u0131na inand\u0131\u011f\u0131, Ermeni, J\u00f6n T\u00fcrk, Bulgar, Makedonyal\u0131, her milletten yoksul insanlar\u0131n siyasi ve siyasi olmayan davalar\u0131n\u0131n avukatl\u0131\u011f\u0131n\u0131 \u00fcstlenirdi.<\/p>\n<p style=\"text-align: justify\">Krikor Zohrab, \u00f6zg\u00fcrl\u00fcklerden, insan haklar\u0131ndan yana, \u0131rk\u00e7\u0131l\u0131\u011fa kar\u015f\u0131 bir hukuk\u00e7u olarak, 1899 y\u0131l\u0131nda Fransa\u2019da g\u00f6r\u00fclen tarihi Dreyf\u00fcs Davas\u0131na, haz\u0131rlad\u0131\u011f\u0131 savunma ile kat\u0131lm\u0131\u015ft\u0131r. Avrupa\u2019da y\u00fckselen Yahudi d\u00fc\u015fmanl\u0131\u011f\u0131 ve \u0131rk\u00e7\u0131l\u0131\u011f\u0131na kar\u015f\u0131 duran Zohrab\u2019\u0131n, ayn\u0131 d\u00f6nemde Abd\u00fclhamit\u2019in istibdad\u0131 alt\u0131nda inleyen Osmanl\u0131 topraklar\u0131nda ya\u015fad\u0131\u011f\u0131n\u0131 unutmamak gerekir.<\/p>\n<p style=\"text-align: justify\"><b>Kitab\u0131n\u0131zda son Osmanl\u0131c\u0131 K. Zohrab yazd\u0131n\u0131z. Zohrab her hangi bir millete \u00f6ncelik vermeyip Osmanl\u0131 imparatorlu\u011funun b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc savunuyor. Zohrab&#8217;\u0131n d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fc Osmanl\u0131 y\u00f6netim modeli nereden kaynakl\u0131yordu ve neydi? Onun bu d\u00fc\u015f\u00fcnceleri Ermeni ayd\u0131nlar ve Osmanl\u0131 y\u00f6netim \u00e7er\u00e7evelerinde nas\u0131l kabul edildi?<\/b><\/p>\n<p style=\"text-align: justify\">Farkl\u0131 milliyetten, etnisiteden ve dinlerden olu\u015fan toplumlar\u0131n bar\u0131\u015f i\u00e7inde birarada, demokratik de\u011ferler alt\u0131nda ya\u015famalar\u0131 fikri g\u00fcn\u00fcm\u00fczde olduk\u00e7a mesafe kat etmi\u015ftir. Osmanl\u0131c\u0131l\u0131k, bunun 100 y\u0131l \u00f6nceki ad\u0131 idi denebilir. Bug\u00fcnden geriye do\u011fru bakt\u0131\u011f\u0131m\u0131zda bu modelin neden tutmad\u0131\u011f\u0131n\u0131 g\u00f6rmek daha kolay olmaktad\u0131r. Her milliyetin kendi topraklar\u0131na, kendi s\u0131n\u0131rlar\u0131na sahip \u00e7\u0131kt\u0131\u011f\u0131, kendi ekonomik kabu\u011funa \u00e7ekildi\u011fi ve dolay\u0131s\u0131yla uluslar\u0131n aras\u0131nda d\u00fc\u015fmanl\u0131klar\u0131n en \u00fcst seviyelere \u00e7\u0131kt\u0131\u011f\u0131 bu d\u00f6nemde, Osmanl\u0131c\u0131l\u0131k ba\u015far\u0131l\u0131 olamam\u0131\u015ft\u0131r. Bu d\u00fc\u015f\u00fcncede olan, Osmanl\u0131 Devleti\u2019nin b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc isteyen insanlar\u0131n, do\u011fru fikirleri savunduklar\u0131n\u0131, ama yanl\u0131\u015f zaman ve ortamda olduklar\u0131n\u0131 ifade etmek gerekir.\u00a0<\/p>\n<p style=\"text-align: justify\">Zohrab\u2019\u0131n da savundu\u011fu bu d\u00fc\u015f\u00fcnce, Ermeni toplumu i\u00e7inde de b\u00fcy\u00fck kabul g\u00f6rm\u00fc\u015ft\u00fcr. Hatta milliyet\u00e7i g\u00f6r\u00fc\u015fleri ile \u00f6n plana \u00e7\u0131kan Ta\u015fnaksutyun\u2019un \u0130stanbul\u2019daki ileri gelenlerinden Agnuni (Ha\u00e7adur Malumyan), 1910 y\u0131l\u0131 ba\u015f\u0131nda, ABD\u2019ye giderek ve burada ya\u015fayan Ermenilere anavatana, yani Osmanl\u0131 anavatan\u0131na geri d\u00f6nme \u00e7a\u011fr\u0131s\u0131 yapm\u0131\u015ft\u0131r. Ne yaz\u0131k ki Agnuni, 1915 y\u0131l\u0131nda 24 Nisan gecesi tutuklanacak ve bir iki ay sonra Urfa ile Diyarbak\u0131r aras\u0131ndaki yolda, \u0130ttihad\u2019\u0131n \u00f6rg\u00fctledi\u011fi \u00e7eteler taraf\u0131ndan \u00f6ld\u00fcr\u00fclecektir.<\/p>\n<p style=\"text-align: justify\">Osmanl\u0131c\u0131l\u0131k, y\u00f6netim \u00e7evrelerinin bir b\u00f6l\u00fcm\u00fcnde kabul g\u00f6rm\u00fc\u015ft\u00fcr. \u0130ttihat ve Terakki\u2019ye muhalif kesimler, bunlar\u0131n siyasal \u00f6rg\u00fct\u00fc H\u00fcrriyet ve \u0130tilaf F\u0131rkas\u0131, Prens Sabahattin \u00e7evresi, Osmanl\u0131c\u0131l\u0131k fikrinin savunucular\u0131yd\u0131.<\/p>\n<p style=\"text-align: justify\">Ancak esen r\u00fczg\u00e2r \u0130ttihat\u00e7\u0131lardan yanayd\u0131 ve arkadan \u00e7\u0131kan D\u00fcnya Sava\u015f\u0131\u2019n\u0131n olu\u015fturdu\u011fu ortam, Osmanl\u0131c\u0131 fikirleri tamamen yok etti. Yerine, uluslar\u0131n birbirini bo\u011fazlama siyasetleri h\u00e2kim oldu ve g\u00fc\u00e7l\u00fc olan taraf, yani \u0130ttihat\u00e7\u0131lar, 1915 y\u0131l\u0131nda Ermenileri Osmanl\u0131 co\u011frafyas\u0131nda silmek \u00fczere harekete ge\u00e7ti.\u00a0<\/p>\n<p style=\"text-align: justify\"><b>Mesela Zohrab&#8217;\u0131n kad\u0131nlar hakk\u0131nda, onlar\u0131n haklar\u0131 \u00fczerinde d\u00fc\u015f\u00fcnceleri zaman i\u00e7inde de\u011fi\u015fti. Siyasi g\u00f6r\u00fc\u015flerinde bir de\u011fi\u015fim ya\u015fand\u0131 m\u0131?<\/b><\/p>\n<p style=\"text-align: justify\">Krikor Zohrab, Osmanl\u0131 topra\u011f\u0131n\u0131n bir insan\u0131 olarak, 20\u2019li ya\u015flardaki kad\u0131nlara bak\u0131\u015f\u0131 ile 40\u2019l\u0131 ya\u015flardaki kad\u0131nlara bak\u0131\u015f\u0131 aras\u0131nda farkl\u0131l\u0131k vard\u0131r.<\/p>\n<p style=\"text-align: justify\">20\u2019li ya\u015flarda, kad\u0131n\u0131n, toplumsal ve ekonomik \u00f6zg\u00fcrl\u00fc\u011fe sahip olmas\u0131 gere\u011fine taraftar olmay\u0131p, aile i\u00e7indeki mutlulu\u011fun belirleyicisi olmas\u0131 fikrinden yanad\u0131r. Zohrab, kad\u0131n\u0131 ailenin ve ahlaki erdemin koruyucusu olarak g\u00f6rmekte idi.<\/p>\n<p style=\"text-align: justify\">Zamanla, d\u00fc\u015f\u00fcncelerinde de\u011fi\u015fim olmu\u015f ve \u00e7a\u011fda\u015f kad\u0131n haklar\u0131n\u0131n, kad\u0131nla erke\u011fin e\u015fitli\u011finin savunuculu\u011funa ge\u00e7mi\u015ftir.<\/p>\n<p style=\"text-align: justify\">1911\u2019de Mecliste yap\u0131lan tart\u0131\u015fmalarda, zina halinde verilecek bir ceza varsa, bu cezan\u0131n \u00e7o\u011funun erke\u011fe verilmesi gerekti\u011fini savunmu\u015ftur. Zaten birden fazla e\u015f sahibi olabilen erke\u011fin, evlilik d\u0131\u015f\u0131 ili\u015fkiye girmesi halinde, bundan dolay\u0131 a\u00e7\u0131lan yasal kovu\u015fturmada, kad\u0131na g\u00f6re daha \u00e7ok ceza almas\u0131n\u0131, \u00e7ok b\u00fcy\u00fck tepkilere ra\u011fmen kararl\u0131l\u0131kla ifade etmi\u015ftir.<\/p>\n<p style=\"text-align: justify\">Siyasi d\u00fc\u015f\u00fcncelerini de, benzer \u015fekilde, \u00f6zg\u00fcrl\u00fcklerden, demokrasiden, insan haklar\u0131ndan yana, ki\u015fi ve toplumlar\u0131n e\u015fitli\u011finden yana geli\u015ftirmi\u015ftir. Zohrab, Bat\u0131\u2019da savunulan, d\u00f6neminin en ileri haklar\u0131n\u0131n, Osmanl\u0131 insan\u0131 i\u00e7in de uygulanmas\u0131 i\u00e7in Meclis-i Mebusan d\u00e2hil her alanda m\u00fccadele vermi\u015ftir.\u00a0<\/p>\n<p style=\"text-align: justify\"><b>Bir siyaset\u00e7i olarak, siyasette duygularla de\u011fil, \u00e7\u0131karlarla ilerlemeyi savunuyordu. Zohrab kendi milletini kurtulu\u015f yolunu, \u0130ttihat ve Terakki Cemiyeti ile i\u015fbirli\u011finde g\u00f6r\u00fcyordu. \u00c7\u00fcnk\u00fc, Zohrab&#8217;\u0131n s\u00f6zleriyle &#8220;\u00e7\u0131karlar\u0131m\u0131z buna zorluyor&#8221;du. Bu partinin aktif \u00fcyesi olup partinin hatalar\u0131 ve kusurlar\u0131 \u00e7ok iyi biliyordu, ama yine de onlar\u0131 tercih ediyor. Zohrab, k\u0131sa zamanda Ahrar F\u0131rkas\u0131\u2019n\u0131n en tan\u0131nm\u0131\u015f ve pop\u00fcler \u015fahsiyetlerinden biri haline gelmi\u015ftir.\u00a0 Ancak 1909 y\u0131l\u0131nda, 31 Mart Olay\u0131 olarak an\u0131lan darbeci giri\u015fimde, Ahrar F\u0131rkas\u0131\u2019n\u0131n da ad\u0131n\u0131n ge\u00e7mesi, Zohrab\u2019\u0131n bu siyasi kurulu\u015ftan ayr\u0131lmas\u0131na vesile olmu\u015ftur. Bundan sonra bir daha herhangi bir siyasi partiye d\u00e2hil olmam\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify\">Meclis se\u00e7imlerinde, \u0130ttihat ve Terakki F\u0131rkas\u0131\u2019n\u0131n kontenjan\u0131ndan milletvekili se\u00e7ilmesine ra\u011fmen, bu parti ile iyi ili\u015fkileri devam etmi\u015f, ancak partili olmam\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify\">Ayn\u0131 \u015fekilde, Ermeni Devrimci Federasyonu (Ta\u015fnaksutyun) ile de yak\u0131n ili\u015fkileri, hatta zaman zaman birlikte \u00e7al\u0131\u015fmalar\u0131 olmas\u0131na ra\u011fmen, bu kurulu\u015fun da \u00fcyesi olmam\u0131\u015ft\u0131r. Bu konuda, de\u011fi\u015fik yaz\u0131mlarda farkl\u0131 bilgiler yer alm\u0131\u015ft\u0131r. Ancak olay\u0131n ger\u00e7ek \u00f6zeti, Zohrab\u2019\u0131n hem \u0130ttihat\u00e7\u0131larla hem de Ta\u015fnaksutyun\u2019la yak\u0131n mesafede olmas\u0131, ama \u00f6rg\u00fctl\u00fc olmamas\u0131 ve g\u00f6rev almam\u0131\u015f olmas\u0131 \u015feklindedir.<\/p>\n<p style=\"text-align: justify\">Parti i\u00e7inde haz\u0131rlanm\u0131\u015f planlar derken, herhalde \u0130ttihat ve Terakki i\u00e7inde haz\u0131rlanm\u0131\u015f planlar\u0131 kastediyorsunuz. Haz\u0131rlanan baz\u0131 planlar\u0131n varl\u0131\u011f\u0131n\u0131 tahmin etmi\u015f, hatta duymu\u015f olabilir. Ancak, bu planlar\u0131n boyutunu tahmin etmemi\u015f olmas\u0131 bir ger\u00e7ektir. 2 Haziran 1915\u2019te tutukland\u0131ktan sonra, \u00f6ld\u00fcr\u00fcl\u00fcnceye kadar ge\u00e7en 47 g\u00fcn boyunca devam eden Diyarbak\u0131r\u2019a gidi\u015f s\u00fcrecinde, Zohrab\u2019\u0131n her\u015feye ra\u011fmen kurtulaca\u011f\u0131na dair inanc\u0131n\u0131 muhafaza etti\u011fini g\u00f6r\u00fcyoruz. Zohrab?
