S\u00f6ylemek istedi\u011fim \u015fuydu: \u201cBu hasar g\u00f6rm\u00fc\u015f an\u0131t yap\u0131n\u0131n, haf\u0131za mekan\u0131n\u0131n d\u00f6n\u00fc\u015f\u00fcm\u00fc yaln\u0131zca piyasac\u0131 bir modelde olmamal\u0131, alternatifleri aranmal\u0131. Farkl\u0131 bir kamusal alan deneyimi i\u00e7in bu d\u00f6n\u00fc\u015f\u00fcme devlet destek vermeli. Yap\u0131n\u0131n korunmas\u0131 ve yeniden i\u015flevlendirilmesinin farkl\u0131 bir kamusal alan deneyimine yol a\u00e7mas\u0131 m\u00fcmk\u00fcn.\u201d<\/p>\n<p>Yetimhane binas\u0131 yaln\u0131zca d\u00fcnyan\u0131n en b\u00fcy\u00fck ah\u015fap yap\u0131lar\u0131ndan biri de\u011fil.<\/p>\n<p>Hem imparatorluk, hem milletle\u015fme dinamiklerinin i\u00e7 i\u00e7e ge\u00e7ti\u011fi d\u00fcnyada e\u015fi benzeri olmayan bir modernle\u015fme s\u00fcrecinin belgesi. Yaln\u0131zca Yetimhane de\u011fil, Heybeli Ruhban (Teoloji) Okulu, Ticaret Enstit\u00fcs\u00fc\u2026 Bu t\u00fcr yap\u0131lar\u0131n ve kurumlar\u0131n d\u00fcnyada e\u015fleri benzerleri yok.<\/p>\n<p>Bu a\u00e7\u0131dan bak\u0131ld\u0131\u011f\u0131nda modern kamu kavram\u0131 ve onunla ilgili politik eylemsellikleri tart\u0131\u015fmak i\u00e7in B\u00fcy\u00fckada Rum Yetimhanesi\u2019nin korunmas\u0131 ve yeniden i\u015flevlendirilmesi kar\u015f\u0131m\u0131za \u00e7\u0131kan e\u015fsiz bir f\u0131rsat.<\/p>\n<p>\u00d6nce \u201cYetimhane bir kamusal alan m\u0131, yoksa \u00f6zel alan m\u0131\u201d, bu soruyla ba\u015flayal\u0131m: Bir e\u011fitim kurumu olarak Yetimhane \u00f6zel bir kurulu\u015fa ait bir yer miydi, yoksa bir kamusal alan m\u0131?<\/p>\n<p>T\u00fcrkiye Cumhuriyeti 2010 y\u0131l\u0131nda Avrupa \u0130nsan Haklar\u0131 Mahkemesi\u2019nin karar\u0131na uygun olarak Yetimhane binas\u0131n\u0131 sahibine iade etti. Asl\u0131nda daha 2007 y\u0131l\u0131nda mahkeme taraf\u0131ndan dava ba\u015fvurusu kabul edildi\u011finde bu soruya bir cevap verilmi\u015fti.<\/p>\n<p>A\u0130HM ba\u015fvurusu kabul edildi\u011fi, karar kesinle\u015fti\u011fi ve iade ger\u00e7ekle\u015fti\u011fi anda iki \u00f6nemli sonu\u00e7 ortaya \u00e7\u0131kt\u0131.<\/p>\n<p>T\u00fcrkiye Cumhuriyeti, Patrikhane\u2019nin t\u00fczel ki\u015fili\u011fini tan\u0131d\u0131. Yetimhane karar\u0131nda ilk defa bir vakf\u0131n, ya da \u00f6zel bir kurulu\u015fun ba\u015fvurusu kabul edilmedi, ya da iadesi ger\u00e7ekle\u015fmedi. Tapu devlet taraf\u0131ndan Rum Ortodoks Patrikhanesi ad\u0131na d\u00fczenlendi.<\/p>\n<p>Bu karar o g\u00fcne kadar tart\u0131\u015fmal\u0131 olan Patrikhane\u2019nin t\u00fczel ki\u015fili\u011finin tan\u0131nmas\u0131 demekti.<\/p>\n<p>Peki bu nas\u0131l oldu? Bir m\u00fclk devletin elinden al\u0131nd\u0131\u011f\u0131 halde bir kamusal alan olarak nas\u0131l kalabilir? (Bu da bence \u00f6nemli ve yerinde bir soru.)<\/p>\n<p>\u0130ade s\u00fcrecinde bir kamu kurulu\u015fu olarak Rum Ortodoks Patrikhanesi muhatap al\u0131nd\u0131 ve onun ki\u015fili\u011fine iade edildi. T\u00fcrkiye Cumhuriyeti \u201ct\u00fczel ki\u015fili\u011fi yok\u201d ya da \u201cben onun t\u00fczel ki\u015fili\u011fini tan\u0131m\u0131yorum\u201d diye A\u0130HM karar\u0131na itiraz etmedi.<\/p>\n<p>Bu karar\u0131n al\u0131nmas\u0131nda dava s\u00fcrecine destek veren ve i\u00e7inde hukuk\u00e7ular\u0131n da oldu\u011fu sivil giri\u015fimin zannedersem \u00f6nemli bir etkisi oldu.<\/p>\n<p>Bu karar T\u00fcrkiye Cumhuriyeti a\u00e7\u0131s\u0131ndan \u2013t\u0131pk\u0131 Lozan Antla\u015fmas\u0131 gibi- \u00f6nemli bir tarihi ve siyasal meseleye i\u015faret ediyordu. Bir \u00f6nceki resmi kamu Rumlar\u0131n kilise, okul, ihtiyarhane gibi kamusal alanlar\u0131n\u0131 ve Patrikhane\u2019yi \u00f6zel alanda konumland\u0131r\u0131yordu. Devlet ilk defa bu toplulu\u011fun kamusal varl\u0131klar\u0131n\u0131 ve haklar\u0131n\u0131 tan\u0131yarak, kabul etmi\u015f oldu.<\/p>\n<p>Bug\u00fcn \u201cYetimhane otel oluyor\u201d gibi sansasyonel haberlerin g\u00f6lgesinde kalan bu geli\u015fme bug\u00fcn ulus-devletin i\u00e7indeki farkl\u0131 topluluklarla ilgili kamusal meseleleri anlamak, yeniden d\u00fc\u015f\u00fcnmek i\u00e7in bir \u00f6rnek.<\/p>\n<p>B\u00f6ylece ilk defa m\u00fc\u015fterek bir kamusal alan fikri kar\u015f\u0131m\u0131zda belirir gibi oldu, farkl\u0131l\u0131klar\u0131n da sek\u00fcler bir kamusal i\u00e7inde var olabilecekleri. Kamusal alan\u0131n sek\u00fclerle\u015fmesi -ve farkl\u0131l\u0131klar\u0131 i\u00e7ine almas\u0131- a\u00e7\u0131s\u0131ndan. Oysa kamusal alan kavram\u0131 \u00f6rt\u00fck olarak sek\u00fcler olmayan (M\u00fcsl\u00fcman-S\u00fcnni) bir \u00f6zellik ta\u015f\u0131yordu. T\u0131pk\u0131 Rumlar\u0131nki (H\u0131ristiyan-Ortodoks) gibi. Bir bak\u0131ma kamusal alan Osmanl\u0131 d\u00f6neminde oldu\u011fu gibi \u201cmillet\u201d sistemi i\u00e7inde yer al\u0131yordu. Di\u011ferlerinin dinsel ve k\u00fclt\u00fcrel kamusal alanlar\u0131n\u0131 kapsam\u0131yordu. Ama di\u011fer taraftan anayasal olarak b\u00fct\u00fcn vatanda\u015flar e\u015fitlik i\u00e7inde olmal\u0131yd\u0131.<\/p>\n<p>\u0130kinci ve \u00f6nemli bir geli\u015fme de \u015fuydu: Bu karar \u201caz\u0131nl\u0131k\u201dla\u015ft\u0131rma s\u00fcrecinin bir uygulama arac\u0131 olan ve vak\u0131flar\u0131n mal edinmelerini k\u0131s\u0131tlamak i\u00e7in d\u00fczenlenmi\u015f olan 36 Beyannamesi\u2019ndeki yer alan ta\u015f\u0131nmazlar\u0131n iadesinin yolunu a\u00e7t\u0131. Yetimhane b\u00f6ylece daha kendisiyle, fiziki varl\u0131\u011f\u0131yla ilgili bir \u201crestorasyon\u201d s\u00fcreci dahi ba\u015flamadan \u00f6nemli bir kamusal alan deneyiminin kap\u0131s\u0131n\u0131 aralad\u0131. Oysa o tarihlere kadar bu m\u00fclklere el koyma planlar\u0131 yap\u0131l\u0131yor, onar\u0131mlar\u0131na dahi izin verilmiyordu.<\/p>\n<p>Bundan 60 y\u0131l \u00f6nce kapat\u0131ld\u0131\u011f\u0131nda ve sonra el konuldu\u011funda, binlerce \u00e7ocu\u011fun e\u011fitim yuvas\u0131 olmu\u015f Yetimhane p\u0131r\u0131l p\u0131r\u0131l ve bak\u0131ml\u0131yd\u0131. 60 y\u0131l boyunca Yetimhane 2010\u2019da A\u0130HM karar\u0131 ile geri verdi\u011finde camlar\u0131, \u00e7er\u00e7eveleri yok olmu\u015f, \u00e7at\u0131s\u0131nda delikler a\u00e7\u0131lm\u0131\u015f bir haldeydi.<\/p>\n<p>Bu y\u00fczden iade s\u00fcrecinde \u201cdevletin Yetimhane\u2019yi sahiplerine, Patrikhane\u2019ye geri vermesi yetmez, onun onar\u0131m\u0131n\u0131, restorasyonunu da finanse etmesi gerekir\u201d diyorduk. Kimileri de -s\u00fctten a\u011fz\u0131 yanan yo\u011furdu \u00fcfleyerek yer misali- \u201cPatrikhane kendi m\u00fclk\u00fc olan Yetimhane binas\u0131n\u0131 b\u00fcy\u00fck zorluklarla, 60 y\u0131l sonra geri alabildi. \u015eimdi devlete geri verilsin mi diyorsunuz\u201d diye tepki g\u00f6steriyorlard\u0131.<\/p>\n<p>\u015eunu s\u00f6yl\u00fcyorduk: \u201cHay\u0131r, tam tersine. Sahiplerinin y\u00f6netimini ve onlar\u0131n kamusal varl\u0131\u011f\u0131n\u0131 tan\u0131yarak.\u201d<\/p>\n<p>T\u00fcrkiye Cumhuriyeti\u2019ni hala 19. y\u00fczy\u0131ldaki gibi neo-klasik modelde \u00f6rg\u00fctlenmi\u015f bir devlet olarak g\u00f6renler oldu\u011fu kesin. Onlar modern -ya da sek\u00fcler- bir devlet i\u00e7inde farkl\u0131l\u0131klar\u0131n kamusal bir varl\u0131\u011f\u0131n\u0131n olabilece\u011fini d\u00fc\u015f\u00fcnemiyorlar. Onlara g\u00f6re \u00f6rne\u011fin Yetimhane gibi yap\u0131lar kamusal de\u011fil, \u00f6zel alanda. Az\u0131nl\u0131kla\u015ft\u0131r\u0131lan topluluklar\u0131n kamusal bir varl\u0131klar\u0131 yok. Vatanda\u015fl\u0131k haklar\u0131n\u0131n bar\u0131\u015f s\u00fcrecinde ne kadar \u00f6nemli oldu\u011funu d\u00fc\u015f\u00fcn\u00fcl\u00fcrse, topluluklar\u0131n kamusal varl\u0131klar\u0131n\u0131n nas\u0131l tan\u0131naca\u011f\u0131na dair siyasal ve hukuki \u00e7er\u00e7evelerin tan\u0131mlanmas\u0131 can al\u0131c\u0131 bir mesele.<\/p>\n<p>Elde \u00f6rnek yok mu? Elbette ki var. \u00d6rne\u011fin 2005-2010 s\u00fcrecinde, T\u00fcrkiye\u2019nin AB adayl\u0131\u011f\u0131 ger\u00e7ekle\u015fti\u011finde bir tak\u0131m \u00f6nemli geli\u015fmeler ya\u015fand\u0131. Bildi\u011fim birka\u00e7 \u00f6rne\u011fi vereyim:<\/p>\n<p>Kumkap\u0131\u2019daki Ermeni Patrikhanesi\u2019nin kar\u015f\u0131s\u0131ndaki mimar Kirkor Balyan taraf\u0131ndan 1838 y\u0131l\u0131nda yap\u0131lan Vorvots Vorodman Kilisesi\u2019nin devlet b\u00fct\u00e7esiyle -ve elbette ki sahiplerinin b\u00fcy\u00fck gayretleriyle- restorasyonu ba\u015far\u0131ld\u0131 ve bu an\u0131t yap\u0131 \u015fehrin kamusal hayat\u0131na kazand\u0131r\u0131ld\u0131. Birka\u00e7 y\u0131ll\u0131k bir m\u00fccadele sonucunda Patrik Mesrop Mutafyan Hazretleri\u2019nin dile\u011fini yerine getirmek \u00fczere.<\/p>\n<p>Bununla ilgili k\u00fc\u00e7\u00fck bir ayr\u0131nt\u0131 da vereyim: A\u00e7\u0131l\u0131\u015fta d\u00f6nemin ba\u015fbakan\u0131 say\u0131n Tayyip Erdo\u011fan k\u00fcrs\u00fcde konu\u015furken yan\u0131ma gelen Ba\u015fbakan Yard\u0131mc\u0131s\u0131 say\u0131n Hayati Yaz\u0131c\u0131 bana \u201csiz inat etmeseydiniz, \u015fimdi bu g\u00fczel olay ger\u00e7ekle\u015fmeyecekti, iyi ki u\u011fra\u015ft\u0131n\u0131z\u201d dedi. Bu s\u00f6zleri beni \u00e7ok d\u00fc\u015f\u00fcnd\u00fcrd\u00fc ve duyguland\u0131rd\u0131. Oysa birka\u00e7 y\u0131l \u00f6ncesine kadar \u201cbize versinler, biz k\u00fclt\u00fcr merkezi yapal\u0131m\u201d diyordu. Ama nedenlerini konu\u015ftu\u011fumuzda hakl\u0131 bulmu\u015ftu, bir hukuk\u00e7u olarak. Yetimhane i\u00e7in A\u0130HM karar\u0131n\u0131n bir emsal te\u015fkil edece\u011fi g\u00f6r\u00fcl\u00fcnce de Vak\u0131flar Yasas\u0131\u2019n\u0131n ilgili maddesi de\u011fi\u015fti, geri verildi.<\/p>\n<p>\u00dczerine kurucusu oldu\u011fu belediye taraf\u0131ndan -uygulama projeleri haz\u0131rlanm\u0131\u015f- kurban kesim merkezi yap\u0131lmak istenilen Hask\u00f6y\u2019\u00fcn tepesindeki Kamondo An\u0131tmezar\u0131 ise mucizevi bir \u015fekilde k\u0131r\u0131lm\u0131\u015f mermer par\u00e7alar toplanarak restore edildi.<\/p>\n<p>Bu deneyimleri tart\u0131\u015fmak ve unutmamak iyi olur.<\/p>\n<p>Bunlar gibi farkl\u0131l\u0131klar\u0131n kamusal varl\u0131klar\u0131n\u0131 tan\u0131yan daha bir\u00e7ok \u00f6rnek var. Demek ki farkl\u0131l\u0131klar\u0131 i\u00e7erebilen bir kamusal alan kavram\u0131 m\u00fcmk\u00fcn.
