Hemen ard\u0131ndan ba\u015flad\u0131\u011f\u0131m Mimar Sinan G\u00fczel Sanatlar \u00dcniversitesi Genel Sosyoloji ve Metodoloji y\u00fcksek lisans\u0131n\u0131, 2019\u2019da \u201cBir Yeralt\u0131 Ekonomisi Olarak Definecilik: Van \u00d6rne\u011fi\u201d ba\u015fl\u0131kl\u0131 tezimle tamamlad\u0131m.<\/p>\n<p>K\u00fcbra \u00c7al\u0131\u015fkan<\/p>\n<p><strong>Neden y\u00fcksek lisans tezinizi definecilik \u00fczerine yapt\u0131n\u0131z?<\/strong><\/p>\n<p>Asl\u0131nda \u00e7ocuklu\u011funun son d\u00f6nemlerini ve ilk gen\u00e7lik y\u0131llar\u0131n\u0131 Van\u2019da ya\u015fam\u0131\u015f biri olarak bu \u015fehir \u00fczerine d\u00fc\u015f\u00fcnmeye ba\u015flam\u0131\u015f olmam olduk\u00e7a yenidir. Bu durumun nedenlerini arad\u0131\u011f\u0131mda san\u0131yorum kar\u015f\u0131ma \u00e7\u0131kan toplumsal, siyasal ve dini s\u00fcre\u00e7ler ba\u015fl\u0131 ba\u015f\u0131na bir \u00e7al\u0131\u015fman\u0131n konusunu olu\u015fturuyor. Kendimi ge\u00e7 kalm\u0131\u015f biri olarak de\u011fil, zaman\u0131n\u0131 bekleyen biri olarak g\u00f6r\u00fcyorum. N\u00fcfus ve etnisite politikalar\u0131na hep ilgili olurken, isk\u00e2n politikalar\u0131 ile tan\u0131\u015fmam\u0131n y\u00fcksek lisans s\u00fcrecinde ger\u00e7ekle\u015fmesinin de bu \u2018do\u011fru zamanla\u2019 bir ba\u011flant\u0131s\u0131 oldu\u011funu d\u00fc\u015f\u00fcn\u00fcyorum. Definecilik konusu, y\u00fcksek lisans program\u0131n\u0131n isk\u00e2n politikalar\u0131 dersinde yapt\u0131\u011f\u0131m\u0131z yo\u011fun tart\u0131\u015fmalar\u0131n birinde, bana bu kap\u0131y\u0131 aralayan sevgili tez dan\u0131\u015fman\u0131m \u015e\u00fckr\u00fc Aslan\u2019\u0131n \u00f6nemle \u00fczerinde durdu\u011fu bir olgu iken, benim i\u00e7in \u00e7ocukluk d\u00fcnyam\u0131n f\u0131s\u0131lt\u0131l\u0131 ve y\u00fcksek sesli konu\u015fmalar\u0131n\u0131n aras\u0131nda hayal meyal hat\u0131rlad\u0131\u011f\u0131m gizemli bir yolculuktan ba\u015fka bir \u015fey de\u011fildi. Ta ki bunu akademik bir s\u00fcrece dahil edebilir miyiz diye d\u00fc\u015f\u00fcnene dek. \u00c7\u00fcnk\u00fc o g\u00fcne kadar definecilik olgusu \u00fczerine \u2018Umut\u2019 filmi ve bitmek bilmeyen \u015fayialar d\u0131\u015f\u0131nda hi\u00e7 d\u00fc\u015f\u00fcnmemi\u015ftim. Lakin g\u00f6rd\u00fcm ki bu \u00fclkede neredeyse her kesimden ve her ya\u015ftan insan\u0131n bir define ve defineci hik\u00e2yesi mevcut. Dolay\u0131s\u0131yla, \u00fczerinde ya\u015fad\u0131\u011f\u0131m\u0131z topra\u011f\u0131n alt\u0131 ayn\u0131 zamanda \u00fclkenin g\u00f6m\u00fcl\u00fc belle\u011fine i\u015faret etmektedir ve ben Van i\u00e7in g\u00f6m\u00fcl\u00fc olan bu belle\u011fin pe\u015fine d\u00fc\u015fmek istedim. Ara\u015ft\u0131rman\u0131n ba\u015f\u0131nda konunun epeyce \u2018d\u0131\u015f\u0131nda\u2019, sadece Vanl\u0131 ve definecilik anlat\u0131lar\u0131n\u0131 belli belirsiz hat\u0131rlayan biri iken, bug\u00fcn definecilikle kendi ailesinin \u00e7arp\u0131c\u0131 hik\u00e2yelerine ula\u015fm\u0131\u015f, atalar\u0131n\u0131n ya\u015fad\u0131\u011f\u0131 co\u011frafyan\u0131n derinliklerine inmi\u015f, d\u00fcn ve bug\u00fcn\u00fcn birbirine ba\u011fland\u0131\u011f\u0131 tarihsellikte Van\u2019\u0131n Ermeni ge\u00e7mi\u015fi ile y\u00fczle\u015fmi\u015f ve konunun ne kadar da \u2018i\u00e7inde\u2019 oldu\u011fumu fark etmi\u015f durumday\u0131m.<\/p>\n<p><strong>Definecilikle ilgili T\u00fcrkiye\u2019de yasal bir d\u00fczenlemenin oldu\u011funu tezinizden \u00f6\u011frendim. Bu yasal d\u00fczenlemenin resmi ve gayriresmi gerek\u00e7eleri nelerdir? Ayr\u0131ca d\u00fczenlemenin i\u00e7eri\u011finden k\u0131saca s\u00f6z eder misiniz?<\/strong><\/p>\n<p>Bu konuda ilk hukuksal d\u00fczenleme 1858 tarihine dayan\u0131yor asl\u0131nda. Bug\u00fcn define aramas\u0131 yapanlar, son halini 1987 y\u0131l\u0131ndaki d\u00fczenlemelerle alan, Medeni Kanun ile desteklenmi\u015f, K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131\u2019n\u0131n uhdesinde 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanun \u2018Define Arama Y\u00f6netmeli\u011fi\u2019 ile define arayabilmektedir.<\/p>\n<p>Y\u00f6netmeli\u011fe g\u00f6re, define arayanlar, define arayacaklar\u0131 yerin m\u00fclki amirine (vali ya da kaymakam) bir dilek\u00e7e ile m\u00fcracaat etmektedir. Dilek\u00e7ede define aranacak yerin a\u00e7\u0131k adresi, yerin gayrimenkul \u00e7e\u015fidi (arazi, ev vb.) ve yere kimin sahip oldu\u011fu (tapulu, tapusuz) belirtilmektedir. Dilek\u00e7eye define aranacak yerin 1\/500 \u00f6l\u00e7ekli harita ve krokisi, detayl\u0131 \u00e7ap plan\u0131, ta\u015f\u0131nmaz\u0131n uzaktan ve yak\u0131ndan \u00e7ekilmi\u015f net g\u00f6r\u00fcnt\u00fcleri, define aranacak yer sahipli ise ger\u00e7ek ki\u015filerden noter tasdikli izin belgesi, 49 t\u00fczel ki\u015filer sahibi ise yetkili mercilerden al\u0131nacak izin belgesi gereklidir. \u0130zinli kaz\u0131 yapma talebi, M\u00fcze Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan kabul edilirse ki\u015fi bir y\u0131ll\u0131k bir izin al\u0131r. Fakat bu izin aral\u0131ks\u0131z bir ay boyunca, en fazla ise 100 metrekarelik bir alanda s\u00fcrd\u00fcr\u00fclebilir. Alan harita ve foto\u011fraflarla belirlenir. M\u00fcze M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan ba\u015fvurunun uygun bulunmas\u0131 halinde define arama ruhsat\u0131 verilmektedir. Define aramas\u0131, define aranacak yere en yak\u0131n m\u00fczeden g\u00f6revlendirilecek uzman personel ba\u015fkanl\u0131\u011f\u0131nda, Maliye ve G\u00fcmr\u00fck, \u0130\u00e7i\u015fleri Bakanl\u0131klar\u0131ndan birer temsilcinin g\u00f6zetiminde yap\u0131lmaktad\u0131r.<\/p>\n<p>\u2018Define Arama Y\u00f6netmeli\u011fi\u2019 ad\u0131yla bir d\u00fczenlemenin oldu\u011funu \u00f6\u011frendi\u011fimde ya\u015fad\u0131\u011f\u0131m \u015fa\u015fk\u0131nl\u0131\u011f\u0131 h\u00e2l\u00e2 an\u0131ms\u0131yorum. \u00c7\u00fcnk\u00fc define arama edimi toplumsal, k\u00fclt\u00fcrel ve ekonomik alanda neredeyse sadece gayriresmi olarak ilerliyor. O halde bu durumun kayna\u011f\u0131 tam olarak nedir? Hi\u00e7 kimse resmi yollara ba\u015fvurarak define aram\u0131yorsa neden bir define arama y\u00f6netmeli\u011fi var? Define arama y\u00f6netmeli\u011finin en b\u00fcy\u00fck dayana\u011f\u0131 yap\u0131lan kaz\u0131 \u00e7al\u0131\u015fmalar\u0131n\u0131n devlet kontrol\u00fcnde, tarihi eserlere zarar verilmeden, sit alanlar\u0131n\u0131 koruyarak yap\u0131lmas\u0131n\u0131 sa\u011flamak. Hem defineyi bulan\u0131n hem de devletin karl\u0131 \u00e7\u0131kaca\u011f\u0131na inan\u0131lan bir s\u00f6zle\u015fme akdi. Fakat sahaya bakt\u0131\u011f\u0131m\u0131zda durumun bu \u015fekilde ilerlemedi\u011fini g\u00f6r\u00fcyoruz. \u00c7\u00fcnk\u00fc devlet mekanizmas\u0131 her haliyle (izinli\/izinsiz) define arama eyleminin ger\u00e7ekle\u015fmesini istiyor. \u0130zinli kaz\u0131larda sit alanlar\u0131 tespit edilse de kazmaya devam edildi\u011fini, mezarl\u0131klar bulunsa da dozerlerin \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, bulunaca\u011f\u0131 varsay\u0131lan definelerin sat\u0131n alma y\u00f6netmeli\u011fi kapsam\u0131nda olduk\u00e7a ucuza elden \u00e7\u0131kar\u0131ld\u0131\u011f\u0131n\u0131 \u00f6\u011freniyoruz. Ayr\u0131ca izinsiz yap\u0131lan kaz\u0131 \u00e7al\u0131\u015fmalar\u0131n\u0131n cezai yapt\u0131r\u0131m\u0131 da olduk\u00e7a az. Bu alan\u0131n b\u00f6ylesine flu kalmas\u0131, definecili\u011fin yasal d\u00fczenlemesinin ard\u0131ndaki gayriresm\u00ee nedenlere bizi g\u00f6t\u00fcr\u00fcyor. Bu durum ulus-devlet mant\u0131\u011f\u0131n\u0131n \u00e7izdi\u011fi yer \u00fcst\u00fcndeki s\u0131n\u0131rlar\u0131 ve tahakk\u00fcmleri yerin alt\u0131nda da devam ettirme iste\u011fine i\u015faret etmektedir. \u0130lk bak\u0131\u015fta maddi varl\u0131klar \u00fczerine y\u00fcr\u00fct\u00fclen bir tart\u0131\u015fma gibi g\u00f6r\u00fcnse de esasen k\u00fclt\u00fcrel miras\u0131n ve ge\u00e7mi\u015fin bozuma u\u011frat\u0131ld\u0131\u011f\u0131, b\u00f6ylelikle egemen siyasal tarih anlat\u0131s\u0131n\u0131n in\u015fa edildi\u011fi fark edilmektedir. Art\u0131k herkesin kendine ait bir yurdu, devleti, ulusu ve yeralt\u0131, yer\u00fcst\u00fc zenginlikleri olmal\u0131d\u0131r. Bu nedenle her toplum sadece kendi makbul buldu\u011fu k\u00f6kenine ait objeleri \u00f6nemsemekte ve kutsamaktad\u0131r. B\u00f6ylelikle yasal d\u00fczenlemeler sayesinde definecilerin makbul kabul edilmeyen gruplar\u0131n k\u00fclt\u00fcrel miras\u0131n\u0131 yok etmesine seyirci kal\u0131nmaktad\u0131r.<\/p>\n<p><strong>Tezinizden \u00f6\u011frendi\u011fimiz bir ba\u015fka ger\u00e7ek de definecilerin define arad\u0131klar\u0131 mek\u00e2na imam, \u2018melle\u2019 gibi bir dini rehberle birlikte gidiyor olmalar\u0131. Bunun nedeni nedir?<\/strong><\/p>\n<p>\u0130mam formel anlamda \u0130slam dininin \u00f6nderi olabilirken melle ise hem imamla e\u015f anlamda hem de formel olarak ba\u015fka bir i\u015f kolunun i\u00e7inde olup dini konularda bilgili olan ki\u015fileri kapsamaktad\u0131r. Bu ki\u015filer babalar\u0131ndan devrald\u0131klar\u0131 dini bilgiler ile de bunu s\u00fcrd\u00fcrebilmektedirler. \u0130mam\u0131n bu a\u011f\u0131n i\u00e7inde yer almas\u0131 hem dinin definecili\u011fe me\u015fruiyet arac\u0131 sa\u011flad\u0131\u011f\u0131n\u0131 hem de imamlar\u0131n alternatif bir yan ekonomi olarak definecili\u011fi kurgulad\u0131klar\u0131n\u0131 g\u00f6steriyor. Definenin hareket etmesine, cinler ve b\u00fcy\u00fcler arac\u0131l\u0131\u011f\u0131yla g\u00f6t\u00fcr\u00fclmesine kar\u015f\u0131 ya da define ba\u015f\u0131nda niyetini bozmu\u015f ki\u015filere kar\u015f\u0131 imam g\u00fcvenlik sa\u011flamaktad\u0131r. Kur\u2019an\u2019\u0131n b\u00fcy\u00fcy\u00fc yok edece\u011fi, cinlerin defineyi hareket ettirece\u011fi inanc\u0131n\u0131 g\u00f6r\u00fc\u015fmecilerin \u00e7o\u011funlu\u011fu kabul ediyor. Ayr\u0131ca dinin sadece bulunmas\u0131 umulan hazinenin tasarruf s\u00fcrecinde de\u011fil, hazinenin bulunma a\u015famas\u0131nda da stratejik bir me\u015fruiyet alan\u0131 sa\u011flad\u0131\u011f\u0131 g\u00f6r\u00fcl\u00fcyor. Belirli dualar okuyarak ve alandaki herkesin abdest almas\u0131n\u0131 zorunlu ko\u015farak definenin ortaya \u00e7\u0131k\u0131\u015f\u0131n\u0131 sa\u011flad\u0131\u011f\u0131 iddia ediliyor. T\u0131ls\u0131mlar\u0131n gizemini \u00e7\u00f6zmeyi vaat eden din adamlar\u0131 bu i\u015fe yeni girmi\u015f \u00e7ok say\u0131da ki\u015fiyi s\u00f6m\u00fcrebiliyor. Defineciler i\u00e7in din \u00f6nemli bir referans ve me\u015fruiyet kayna\u011f\u0131d\u0131r. \u00d6rne\u011fin tezimdeki g\u00f6r\u00fc\u015fmecilerin tamam\u0131 bulacaklar\u0131na inand\u0131klar\u0131 definenin zekat\u0131n\u0131 vermeden i\u015f yapmamalar\u0131 gerekti\u011fini yoksa o mal\u0131n hayr\u0131n\u0131 g\u00f6remeyeceklerini d\u00fc\u015f\u00fcnmektedir. Definecilerin yo\u011funlukla dini s\u00f6yleme b\u00fcr\u00fcnmelerinin sebebi kendilerine i\u00e7lerinde f\u0131s\u0131ldanan, bulmaya \u00e7al\u0131\u015ft\u0131klar\u0131 mallar\u0131n bir d\u00f6nemin insan\u0131n\u0131n ya\u011fmalanm\u0131\u015f mallar\u0131 oldu\u011fu ger\u00e7e\u011fi olabilmektedir. \u0130ade edilemeyenlerin bedeli olarak tasarlanan unsur, hazinenin zekat\u0131n\u0131n verilmesidir. Bu \u015fekilde ulus-devlet nosyonunun isk\u00e2n politikalar\u0131n\u0131n bir neticesi olarak gayrim\u00fcslim mallar\u0131na el koyma prati\u011fi, yer alt\u0131ndaki el koyulan mallar\u0131n da \u2018T\u00fcrkle\u015ftirilmesi\u2019 ve \u2018M\u00fcsl\u00fcmanla\u015ft\u0131r\u0131lmas\u0131\u2019 prati\u011fini do\u011furdu\u011fu s\u00f6ylenebilir.<\/p>\n<p><strong>Tezinizin sonu\u00e7 b\u00f6l\u00fcm\u00fcnde definecili\u011fin asl\u0131nda bir t\u00fcr \u2018ge\u00e7mi\u015fle y\u00fczle\u015fme\u2019 oldu\u011funu belirtiyorsunuz. Bunu a\u00e7ar m\u0131s\u0131n\u0131z?<\/strong><\/p>\n<p>Ben \u00e7al\u0131\u015fmaya ba\u015flarken herhangi bir y\u00f6nlendirme olmadan Ermeni g\u00f6m\u00fcs\u00fc arayan definecilerle g\u00f6r\u00fc\u015fmeler yapmaya \u00e7al\u0131\u015f\u0131yordum lakin definecilerin beni ge\u00e7mi\u015fin unutulmak istenen taraflar\u0131na bu kadar yo\u011fun bir \u015fekilde g\u00f6t\u00fcrece\u011fini de hi\u00e7 hesap etmemi\u015ftim. S\u00fcrekli olarak g\u00f6r\u00fc\u015fmeciler arad\u0131klar\u0131 g\u00f6m\u00fclerin sahipleri olmad\u0131\u011f\u0131n\u0131 savunurken t\u00fcm g\u00f6r\u00fc\u015fmelerde s\u00fcrekli kula\u011f\u0131mda \u00e7\u0131nlayan \u201cBir g\u00fcn bir Ermeni gelir\u201d s\u00f6z\u00fc vard\u0131. Bu bana Freud\u2019un tekinsizlik kavram\u0131n\u0131 hat\u0131rlatm\u0131\u015ft\u0131. \u2018Tekinsiz\u2019 zaman\u0131nda bize tan\u0131d\u0131k olan\u0131n yabanc\u0131la\u015fmas\u0131d\u0131r. \u00d6nceden evin i\u00e7erisinde, bizimle beraber olan, sonras\u0131nda evimizde kar\u015f\u0131m\u0131za bir hayalet gibi \u00e7\u0131karak bizi tedirgin eder. Aynen Van\u2019\u0131n \u00fczerinde dola\u015fan Ermeni hayaletinde oldu\u011fu gibi\u2026 G\u00f6r\u00fc\u015fmeciler bir g\u00fcn bir Ermeni gelir derken bildik ve tan\u0131d\u0131k birinden bahsediyor, konu\u015fman\u0131n sonunda tan\u0131d\u0131k olan\u0131n yabanc\u0131la\u015ft\u0131\u011f\u0131, mistik bir hale b\u00fcr\u00fcnd\u00fc\u011f\u00fc ve ara s\u0131ra \u00f6c\u00fcle\u015fti\u011fi g\u00f6zler \u00f6n\u00fcne seriliyordu. Tarihin bir yerinde gizlenen bu tekinsizlik, bir g\u00fcn aniden kar\u015f\u0131m\u0131zda \u2018define\u2019 ile belirivermekte ve art\u0131k bu y\u00fczle\u015fmeden, 1915\u2019te ya\u015fananlardan ka\u00e7mak \u00e7ok da m\u00fcmk\u00fcn g\u00f6r\u00fcnmemektedir. Ermeni ge\u00e7mi\u015finin Van\u2019da h\u00e2l\u00e2 nas\u0131l canl\u0131 ve diri oldu\u011funu a\u00e7\u0131lan \u00e7ukurlarda, t\u00fcmseklerde g\u00f6rmek, bu haf\u0131zan\u0131n definecilik ile asl\u0131nda yok edilmeye \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131 yerde yeniden \u00fcretildi\u011fini de g\u00f6zler \u00f6n\u00fcne sermektedir.
