G\u00f6n\u00fcl isterdi ki \u201cilk gece hakk\u0131na\u201d g\u00f6sterilen hassasiyetin hi\u00e7 de\u011filse \u00e7eyre\u011fini soyk\u0131r\u0131m if\u015fas\u0131nda da g\u00f6rebilseydik. Soyk\u0131r\u0131m\u0131n afi\u015fe edilmesi noktas\u0131nda yapt\u0131\u011f\u0131 cesur i\u015f m\u00fcnasebetiyle Ak\u00e7am, iltifattan \u00e7ok tahkir lugat\u0131na al\u0131\u015fk\u0131nd\u0131r. Fakat bu sefer benzer c\u00fcmleleri kimi K\u00fcrt okumu\u015flar\u0131ndan g\u00f6rmesi tarihin cilvesi olsa gerek. Yanl\u0131\u015f dahi olsa Ak\u00e7am\u2019\u0131n fikirlerine, fikirle mukabele etmek m\u00fcmk\u00fcnken onun bildirisel bir k\u0131namaya muhatap k\u0131l\u0131nmas\u0131 hayra alemet de\u011fil. Ayr\u0131ca da d\u00fc\u015f\u00fcnd\u00fcr\u00fcc\u00fc. Fakat \u015fu da var ki Ak\u00e7am, her ne kadar niyeti \u00f6yle olmasa bile kulaktan kula\u011fa yay\u0131lan soyk\u0131r\u0131mdaki K\u00fcrt i\u015ftiraki tart\u0131\u015fmas\u0131n\u0131 ray\u0131ndan \u00e7\u0131karm\u0131\u015f g\u00f6r\u00fcn\u00fcyor. Bu k\u0131sa introdan sonra tart\u0131\u015fman\u0131n \u00f6z\u00fcne dair kimi noktalar\u0131 sarih k\u0131lmak \u015fart g\u00f6r\u00fcn\u00fcyor.<\/p>\n<p>\u00d6ncelikle ilk gece hakk\u0131n\u0131n, Orta\u00e7a\u011f tarihini \u00e7al\u0131\u015fanlar a\u00e7\u0131s\u0131ndan bile hen\u00fcz tamamen kabul edilmi\u015f bir mesele olmad\u0131\u011f\u0131n\u0131 tespit etmekle ba\u015flayal\u0131m. Bunu bir mit olarak g\u00f6renler oldu\u011fu gibi ya\u015fand\u0131\u011f\u0131n\u0131 kabul edenler de var \u015f\u00fcphesiz. Ne var ki bu Orta\u00e7a\u011f tarihi konusunun uzmanlar\u0131na bakmam\u0131z icap eder.\u00a0<em>Feodal Toplum<\/em>\u00a0kitab\u0131n\u0131n usta yazar\u0131n\u0131n bu hakk\u0131 k\u00fclt \u00e7al\u0131\u015fmas\u0131nda lafzen bile anmamas\u0131 dikkat \u00e7ekicidir mesela. Sadece bir yerde \u201cserfli\u011fin de\u011fi\u015fimleri\u201dni ele al\u0131rken Katalonya ba\u011flam\u0131nda \u015f\u00f6yle bir c\u00fcmle kullan\u0131r:\u00a0<em>\u201c..e\u011fer serf k\u0131z bekaretini kaybederse, seny\u00f6re para cezas\u0131 \u00f6demesi..\u201d\u00a0<\/em>gerekirdi. (Bloch-2015) Kitap ba\u011flam\u0131nda zorlama bir yorumla bu c\u00fcmleden yola \u00e7\u0131k\u0131p meseleye bakt\u0131\u011f\u0131m\u0131zda o d\u00f6nem Avrupas\u0131\u2019n\u0131n ta\u015fras\u0131 olabilecek baz\u0131 b\u00f6lgelerinde seny\u00f6r\u00fcn, serf ya da serfli\u011fe yak\u0131n toplumsal kesimler \u00fczerinde bedensel haklar iddia etti\u011finin tespitini yapabiliriz. Yine de bu durumun kitabi manada ilk gece hakk\u0131na tam tekab\u00fcl edip etmeyece\u011fi yoruma a\u00e7\u0131k.<\/p>\n<p>Fakat \u00f6te yandan feodal ortamlarda evlilik meselesinin ba\u015fka g\u00f6r\u00fcn\u00fcmlerine bakmak konumuz bak\u0131m\u0131ndan \u00f6nemli. Evliliklerin her zaman ki\u015fisel bir se\u00e7im yapmak \u015feklinde p\u00fcr\u00fczs\u00fcz bir muameleye konu olmad\u0131\u011f\u0131n\u0131 biliyoruz. Daha a\u00e7\u0131k olmak gerekirse Orta\u00e7a\u011f Avrupas\u0131\u2019nda seny\u00f6r\u00fcn b\u0131rakal\u0131m serfin \u00e7ocu\u011funun evlenmesinde, vassalin \u00e7ocu\u011fu evlendi\u011finde bile s\u00f6z hakk\u0131 vard\u0131. Seny\u00f6r\u00fcn evliliklere bu tarz m\u00fcdahaleleri Almanya ve Fransa\u2019da yayg\u0131n olarak g\u00f6r\u00fcl\u00fcyordu. Hatta evlenecek kad\u0131nlar Fransa\u2019da \u2018z\u0131rh fiefi\u2019 alm\u0131\u015flarsa bu durumda seny\u00f6r\u00fcn istedi\u011fi ki\u015fi ile evlenmek zorundayd\u0131. Benzer bir durum \u0130ngiltere\u2019de I. Henry d\u00f6neminde kral ferman\u0131yla yasa haline bile gelmi\u015fti. (Bloch-2015) Feodal d\u00f6nem \u201cinsan\u0131n insana tabiyetinin finali\u201d anlam\u0131n\u0131 ta\u015f\u0131d\u0131\u011f\u0131 \u00f6l\u00e7\u00fcde bu tarz kural d\u0131\u015f\u0131l\u0131klar ya\u015fan\u0131yordu.<\/p>\n<p><strong>A\u011fal\u0131\u011f\u0131n De\u011fi\u015fen Sosyolojisi<\/strong><\/p>\n<p>Bu mukayeseli tarih ba\u011flam\u0131nda K\u00fcrt aristokratlar\u0131 ile s\u0131radan K\u00fcrtler, K\u00fcrt a\u011falar\u0131 ile Ermenilerin m\u00fcnasebetlerine bakmak faydal\u0131 olacakt\u0131r. Bu yaz\u0131daki tematikler ve \u00f6znelerin geneli kapsamad\u0131\u011f\u0131, d\u00f6nem ve mekanla s\u0131n\u0131rl\u0131 oldu\u011funun alt\u0131n\u0131 \u00e7izmek isterim. Ayr\u0131ca ilk gece hakk\u0131 a\u015fa\u011f\u0131da geni\u015f\u00e7e anlat\u0131lacak arka plan dahilinde ele al\u0131nmal\u0131 ve yorumlanmal\u0131d\u0131r.<\/p>\n<p>Zira d\u00f6nemselle\u015ftirme ve mekansalla\u015ft\u0131rma yapmak konunun anla\u015f\u0131lmas\u0131 i\u00e7in \u00f6nem arz eder. K\u00fcrdistan\u2019da, \u00f6zellikle de K\u00fcrtler ile Ermenilerin ya\u015fad\u0131\u011f\u0131 melez ortamlarda talan, zorbal\u0131k, k\u0131z ka\u00e7\u0131rma, tecav\u00fcz, d\u00fc\u011f\u00fcnlere m\u00fcdahale edilmesi gibi vakalar\u0131n 1860-1900 y\u0131llar\u0131 aras\u0131n\u0131 kapsayan zaman dilimin i\u00e7inde mebzul miktarda artt\u0131\u011f\u0131 raporlarla ve tan\u0131kl\u0131klarla sabit. Bir istatistik vermek gerekirse s\u00f6zgelimi 1860-1870 y\u0131llar\u0131 aras\u0131nda Ermeni patrikli\u011fin, Osmanl\u0131 h\u00fck\u00fcmetine bu su\u00e7lar\u0131 konu edinen 529 takrir sunmu\u015f oldu\u011funu g\u00f6rmekteyiz. Bunlar\u0131n 65\u2019i Diyarbekir b\u00f6lgesi, 79\u2019u Erzurum b\u00f6lgesine aitti. (Sasuni-1992) Peki ama ne oldu da birden bu su\u00e7 istatistikleri tavan yapt\u0131?<\/p>\n<p>Bunda ku\u015fkusuz birinci etken Osmanl\u0131 devletinin a\u015f\u0131r\u0131 \u015fiddet e\u015fli\u011finde carile\u015ftirdi\u011fi ve o d\u00f6nemin belgelerinde yaz\u0131ld\u0131\u011f\u0131 haliyle\u00a0<em>\u201cK\u00fcrdistan\u2019\u0131n m\u00fckerrer fethi\u201d<\/em>ydi. Moltke\u2019nin \u015fahitli\u011finde d\u00f6nemin komutanlar\u0131 ta\u015f \u00fcst\u00fcnde ta\u015f b\u0131rakmazken bu arada ortadan kald\u0131r\u0131lmas\u0131 hedeflenen K\u00fcrt mirlikleri tarihe kar\u0131\u015fm\u0131\u015ft\u0131. K\u00fcrt toplumunu canl\u0131 bir organizmaya benzetirsek, K\u00fcrtlerin ba\u015f\u0131 kesilmi\u015f, g\u00f6vdesi orta yerde kan kaybediyordu. Bu sebeple Sasuni\u2019nin, K\u00fcrt-Ermeni ili\u015fkilerinin bozulmas\u0131n\u0131n milad\u0131n\u0131 Bedirhan beyin yenilgisine ba\u011flamas\u0131 kesinlikle isabetli bir yakla\u015f\u0131md\u0131r. (Sasuni-1992)<\/p>\n<p>\u0130kinci etken K\u00fcrtlerin kolonyalist tasar\u0131ma al\u0131nmas\u0131yla do\u011frudan ba\u011flant\u0131l\u0131yd\u0131. Seferler sonucunda b\u00fcy\u00fck a\u015firet konfederasyonu da\u011f\u0131ld\u0131\u011f\u0131nda K\u00fcrt toplumunda bir \u00e7e\u015fit kabile r\u00f6nesans\u0131 ya\u015fand\u0131. A\u015firet konfederasyonlar\u0131ndan mikro \u00f6l\u00e7ekteki kabile \u00f6rg\u00fctlenmesine d\u00f6n\u00fc\u015f K\u00fcrt toplumunda tam anlam\u0131yla a\u011fa enflasyonuna sebebiyet verdi. Yani bu d\u00f6nemde ciddi bir toplumsal de\u011fi\u015fim ya\u015fan\u0131yordu ve bu s\u00fcre\u00e7 devlet destekli Hamidiye A\u011falar\u0131 s\u00fcreci ile K\u00fcrt toplumunu yenilenen bir feodalizm dalgas\u0131yla y\u00fcz y\u00fcze b\u0131rakm\u0131\u015ft\u0131.<\/p>\n<p>Bu a\u011falar\u0131n tam g\u00f6\u00e7ebelikten yar\u0131 g\u00f6\u00e7ebeli\u011fe ge\u00e7i\u015fleri hem iktisadi kaynaklar hem de K\u00fcrt-Ermeni hinterland\u0131ndaki etnik ikilik dengesini K\u00fcrtler lehine bozmaya ba\u015flad\u0131. 1858 Arazi Kanunnamesi g\u00f6\u00e7ebe feodalizminden, tar\u0131msal \u00f6l\u00e7ekli feodalizme ge\u00e7i\u015f i\u00e7in iyi bir f\u0131rsatt\u0131. Yeni yetme a\u011falar bir taraftan feodal art\u0131\u011fa el koyarken \u00f6b\u00fcr taraftan talanlarla kendi b\u00f6lgelerine hem s\u0131n\u0131rlar \u00e7izdi hem de g\u00fc\u00e7s\u00fcz ve himayeye muhta\u00e7 kesimleri b\u00f6lgesine katt\u0131.<\/p>\n<p>Ermeni yerle\u015fimciler b\u00f6ylelikle ilk kez serf benzeri bir konumla y\u00fcz y\u00fcze geldi. \u00d6nce kolonyal seferler ard\u0131ndan da a\u011falar\u0131n \u015fiddeti Ermeniler i\u00e7in \u00f6ncelikle g\u00fcvenlik sorununu ortaya \u00e7\u0131kard\u0131. A\u011falara himaye kar\u015f\u0131l\u0131\u011f\u0131nda daha a\u011f\u0131r vergiler \u00f6demeye ba\u015flad\u0131lar. Buna benzer bir ortam Macar g\u00f6\u00e7ebeli\u011finin alt \u00fcst etti\u011fi Orta\u00e7a\u011f Avrupas\u0131\u2019nda da g\u00f6r\u00fclm\u00fc\u015ft\u00fc. \u00d6zg\u00fcr kimseler kendisine bir koruyucu ar\u0131yor ve bunu sa\u011flamak i\u00e7in k\u00f6leli\u011fe raz\u0131 oluyordu.<\/p>\n<p>Burada art\u0131k esas soruna gelmi\u015f bulunuyoruz. Bu d\u00f6nem ve mekandaki K\u00fcrt a\u011falarla himayesine ald\u0131\u011f\u0131 Ermenilerin ili\u015fkisi nas\u0131ld\u0131? Hangi hukuk cariydi? Hat\u0131rlayal\u0131m ki, Orta\u00e7a\u011f Avrupas\u0131\u2019nda k\u00f6le, bir efendinin e\u015fyas\u0131 say\u0131l\u0131yordu ve efendi onun v\u00fccudu, eme\u011fi ve mallar\u0131 \u00fczerinde tasarruf hakk\u0131na sahip bulunuyordu. Bahse konu Ermenileri\u00a0<em>xulam<\/em>\u00a0olarak niteleyebilir miyiz? De\u011filse bu e\u015fitsiz ili\u015fkinin do\u011fas\u0131 ve s\u0131n\u0131rlar\u0131 nereye kadard\u0131? Bir c\u00fcmleyle \u00f6zetlemek gerekirse b\u00fct\u00fcn K\u00fcrdistan\u2019daki Ermeniler de\u011fil ama bu bahisteki Ermenilerin konumu tam da \u015fuydu. Avrupa\u2019da efendiden belli bir toprak par\u00e7as\u0131 al\u0131p da kendi kendisine yeten ve efendinin m\u00fcdahalesine k\u00f6lelere nazaran daha seyrek maruz kalan \u2018yar\u0131 k\u00f6le yar\u0131 serf kar\u0131\u015f\u0131m\u0131\u2019 bir stat\u00fcyd\u00fc. 1877 y\u0131l\u0131nda Siirt, Bitlis ve Mu\u015f\u2019u gezen Rassam\u2019\u0131n b\u00fcy\u00fckel\u00e7i Layard\u2019a g\u00f6nderdi\u011fi raporda benzer \u015feyler yaz\u0131yordu: \u201cYapt\u0131\u011f\u0131m soru\u015fturmalardan anlad\u0131\u011f\u0131ma g\u00f6re K\u00fcrdistan da\u011flar\u0131nda k\u00f6lelik tamam\u0131yla kald\u0131r\u0131lmam\u0131\u015f. N\u00fcfuz edilemeyen da\u011fl\u0131k b\u00f6lgelerdeki Hristiyan k\u00f6yleri i\u00e7inde ya\u015fayanlarla birlikte sat\u0131l\u0131p al\u0131nmakta.\u201d (Yarman-2015)<\/p>\n<p><strong>\u0130lk Gece Hakk\u0131 (m\u0131?)<\/strong><\/p>\n<p>\u015eimdi art\u0131k sadede gelebiliriz. E\u011fer bahse konu yerdeki Ermeniler yar\u0131\u00a0<em>xulam<\/em>yar\u0131 serf stat\u00fcs\u00fcndeyse bu durumda K\u00fcrt a\u011falar\u0131 onlar\u0131n bedenleri \u00fczerinde tasarruf hakk\u0131na sahip miydi? \u0130lk gece hakk\u0131 ba\u011flam\u0131nda bu sorunun cevab\u0131 kesinlikle negatifti. K\u00fcrt a\u011falar\u0131 ba\u015fka pek \u00e7ok zul\u00fcm yapt\u0131 elbette. Haks\u0131z vergiler ald\u0131lar, yok yere sudan gerek\u00e7elerle Ermeni \u00f6ld\u00fcrd\u00fcler, talan yapt\u0131lar, zalimane usullerle k\u0131z ka\u00e7\u0131rd\u0131lar, \u0131rza ge\u00e7tiler, pogromlara kat\u0131ld\u0131lar, Yani y\u00fcz k\u0131zart\u0131c\u0131 su\u00e7 sicilleri hayli kabar\u0131kt\u0131. Ne var ki bu sicilde ilk gece hakk\u0131 diye bir y\u00fcz k\u0131zart\u0131c\u0131 su\u00e7 yoktu.<\/p>\n<p>K\u00fcrt toplumunda ilk gece hakk\u0131 diye bir uygulamay\u0131 tarih boyunca kaydeden bir K\u00fcrt yaz\u0131l\u0131 kayna\u011f\u0131 bulunmad\u0131\u011f\u0131 gibi bunu ima eden anlat\u0131mlar da s\u00f6z konusu de\u011fildir. Sadece K\u00fcrt kaynaklar\u0131 de\u011fil, Misyonerlerin raporlar\u0131nda da bu hakk\u0131n imas\u0131 bile yoktur. (Kieser-2005) Ayr\u0131ca k\u0131ymetli yazar Kieser\u2019le yapt\u0131\u011f\u0131m\u0131z yaz\u0131\u015fmada da kendisi b\u00f6yle bir vakay\u0131 belgeleyen hi\u00e7 bir rapora denk gelmedi\u011fini teyit etti. \u0130laveten ula\u015fabildi\u011fimiz Ermeni \u015fikayetlerini konu alan raporlarda bu vakay\u0131 ele alan bir \u015fikayete tesad\u00fcf etmi\u015f de\u011filiz. Hatta Palu b\u00f6lgesinin Ermeni \u015fikayetlerini dinlemeye gelen bir rapor yazar\u0131 buradaki K\u00fcrt a\u011falar\u0131n\u0131\u00a0<em>\u201cinsan yiyen vah\u015fi\u201d<\/em>\u00a0(Natanyan-2015) olarak betimlemesine ra\u011fmen ilk gece hakk\u0131ndan bahsetmez.<\/p>\n<p>\u00c7ok daha \u00f6nemlisi 8 Kas\u0131m 1871 y\u0131l\u0131nda Ermeni Milli Meclisi oturumuna sunulan \u201cTa\u015fraya \u00d6zg\u00fc Kanunsuz Eylemleri\u201d soru\u015fturan raporun 4. B\u00f6l\u00fcm\u00fc K\u00fcrt-Ermeni ili\u015fkileri ba\u011flam\u0131nda\u00a0<em>\u201c\u00d6zel Zul\u00fcm\u201d<\/em>\u00a0ba\u015fl\u0131\u011f\u0131yla kaleme al\u0131nm\u0131\u015ft\u0131. Bu iddiay\u0131 ortaya atan kaynaklar\u0131n \u00f6rnek vakalar\u0131 da bu d\u00f6neme ait gibi g\u00f6r\u00fcnmektedir. Ne var ki bu tarihi \u00f6neme haiz rapora dair bilgi veren Sasuni, ilk gece hakk\u0131 benzeri bir \u015feyden s\u00f6z etmemektedir. (Sasuni-1992) Bahse konu rapor okunmadan temkinli olmak gerek elbet ama en az\u0131ndan bu yaz\u0131da bahsedilen kaynaklar itibariyle K\u00fcrtlerde ilk gece hakk\u0131n\u0131n s\u00f6z konusu olmad\u0131\u011f\u0131n\u0131 tespit etmek m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>Peki Ak\u00e7am ve referans verdi\u011fi kaynaklar neden b\u00f6yle bir tan\u0131mlama yapm\u0131\u015f olabilir? Bu arada sadece Ak\u00e7am\u2019\u0131n refere etti\u011fi \u0130ssawi, Astorian, Lazarev gibi yazarlar de\u011fil Barsoumian da bu tarz bir bilgiyi payla\u015fmaktad\u0131r. Ak\u00e7am\u2019\u0131n refere etti\u011fi kaynaklara bakt\u0131\u011f\u0131m\u0131zda \u015funlar\u0131 g\u00f6rmekteyiz:<\/p>\n<p>\u201c-Sasun vilayetinde Ermeniler K\u00fcrt beylere khafir ad\u0131nda vergi veriyordu.<\/p>\n<p>-Koruma kar\u015f\u0131l\u0131\u011f\u0131nda al\u0131nan khafir mahsul veya zanaat \u00fcr\u00fcnleri cinsinden tahsil edilirdi.<\/p>\n<p>-K\u00f6yl\u00fcler xulam gere\u011fi feodaliteden a\u015fina oldu\u011fumuz angaryay\u0131\u00a0<em>(corvee)<\/em>hat\u0131rlatan mecburi hizmeti yerine getirirdi.<\/p>\n<p>-D\u00fc\u011f\u00fcnlerde beyler \u00e7eyizin yar\u0131s\u0131n\u0131 hediye olarak al\u0131rd\u0131. Baz\u0131 beyler ilk gece hakk\u0131na sahipti. Fakat bu verginin \u00f6zellikle Ermenilerin evliliklerinde \u00e7ok daha fazla tutar olarak al\u0131nd\u0131\u011f\u0131ndan bahseder.
