Alevi katliamlar\u0131n\u0131n hem devlet ve hem de toplumsal \u015fiddet ile bu \u015fekildeki bulu\u015fmas\u0131n\u0131n do\u011fru hukuki ele\u015ftirisinin yap\u0131lmas\u0131 ve buna ili\u015fkin bir ceza hukuku k\u00fcrs\u00fcs\u00fcn\u00fcn a\u00e7\u0131lmas\u0131 hem T\u00fcrkiye hukuk d\u00fczeninin temel karakteristi\u011fini hem de Alevili\u011fin T\u00fcrkiye\u2019nin hukuk d\u00fczeni i\u00e7inde nereye yerle\u015ftirildi\u011fini a\u00e7\u0131kl\u0131kla if\u015fa edecek niteliktedir. Alevilik ve hak bahsi a\u00e7\u0131s\u0131ndan en \u00f6nemli noktalardan birisi i\u015fte bu soyk\u0131r\u0131m sorunudur ve \u00fczerinde daha ciddiyetle d\u00fc\u015f\u00fcn\u00fclmeye ba\u015flanmal\u0131d\u0131r.<\/em><\/strong><\/p>\n<p><strong>Orhan Gazi Ertekin<\/strong><\/p>\n<p>Alevi \u00e7al\u0131\u015fmalar\u0131n\u0131n hak, hukuk ve adalet bahsindeki kavramsal haz\u0131rl\u0131ks\u0131zl\u0131\u011f\u0131 giderek a\u00e7\u0131\u011fa \u00e7\u0131k\u0131yor. Bu durum hem \u201cAlevilik \u00e7al\u0131\u015fmalar\u0131\u201d hem de \u201cAlevilerin \u00e7al\u0131\u015fmalar\u0131\u201d i\u00e7in ge\u00e7erli. Alevilik \u00e7al\u0131\u015fmalar\u0131nda hukuk ara\u015ft\u0131rmalar\u0131n\u0131n disiplinini edinme ve sorular\u0131 bir de burada sorup cevaplama, bir bilgi ve disiplin alan\u0131na d\u00f6n\u00fc\u015ft\u00fcrme ihtiyac\u0131 her nas\u0131lsa hissedilmemi\u015f, Alevilerin ise kendilerine y\u00f6nelen her soruyu \u00e7ok kolay anla\u015f\u0131l\u0131p mazur g\u00f6r\u00fclebilecek bir \u201cma\u011fduriyet\u201d \u00fczerinden anlama e\u011filimi hak bahsi ile ili\u015fkilerini reaksiyoner bir k\u0131s\u0131tl\u0131l\u0131k i\u00e7inde tutmak sonucunu do\u011furmu\u015f. \u00d6rne\u011fin Hanefi fukahas\u0131na g\u00f6sterilen ola\u011fan\u00fcst\u00fc ilgi yok Alevilik \u00e7al\u0131\u015fmalar\u0131nda. Alevilerde de \u201chak\u201d bahsi ile nas\u0131l ili\u015fkileceklerine dair soru\u015fturmalara rastgelinmiyor. Sorunu daha da k\u0131s\u0131tl\u0131 ve zor hale getiren bir \u015fey daha var ki o da \u201cAlevilik \u00e7al\u0131\u015fmalar\u0131\u201d ile \u201cAlevilerin \u00e7al\u0131\u015fmalar\u0131\u201dn\u0131n neredeyse \u00f6zde\u015f hale gelmesi. B\u00f6ylece Alevilik \u00e7al\u0131\u015fmalar\u0131 nesnellik ve kamusall\u0131k \u00f6zelli\u011fini belirli \u00f6l\u00e7\u00fcde yitirerek Alevilerin kendi i\u00e7indeki ucu buca\u011f\u0131 olmayan \u00e7eki\u015fmelerin ve farkl\u0131 \u201ck\u00fclt\u00fcrel sermaye\u201dlerin k\u0131skan\u00e7 bi\u00e7imlerde hesapla\u015ft\u0131\u011f\u0131 bir \u00f6znellikler sahas\u0131na d\u00f6n\u00fc\u015f\u00fcyor.<\/p>\n<p>Alevilik ve Aleviler \u00fczerine yap\u0131lan her yeni bilimsel \u00e7al\u0131\u015fman\u0131n, her \u00f6rg\u00fctsel giri\u015fim ve politik temsil davetinin ve tabii ki her farkl\u0131 \u201chak\u201d bahsinin kal\u0131c\u0131 bir toplumsal ihtiyaca i\u015faret etmedi\u011fi s\u00fcrece geleneksel \u00e7eki\u015fmelere i\u015flevselli\u011fi a\u00e7\u0131s\u0131ndan de\u011ferlendirilme tehlikesi de buradan do\u011fuyor ku\u015fkusuz. \u015eimdi ben burada o geni\u015f \u00f6znellikler sahas\u0131n\u0131n m\u00fcmk\u00fcn oldu\u011fu kadar d\u0131\u015f\u0131nda durmaya \u00e7al\u0131\u015farak Alevilik ve hukuk meselesinin neden \u00f6nemli oldu\u011funu bir kez daha anlatmaya giri\u015fecek ve \u201cAlevilik ve Hukuk\u201d alan\u0131na ili\u015fkin bilimsel ve politik giri\u015fimlerin hem Aleviler hem de Alevi olmayanlar\u0131n toplumsal ya\u015fam imkanlar\u0131 i\u00e7in ne kadar anlaml\u0131 oldu\u011funu fark ettirmeyi deneyece\u011fim. \u0130lk olarak Alevili\u011fin hak ve hak hareketleri ba\u011flam\u0131nda heterojen bir din-mezhep-yol olarak homojen etnik-k\u00fclt\u00fcrel gruplarla kar\u0131\u015ft\u0131r\u0131lmas\u0131 ele\u015ftirisinin ne kadar sorunlu oldu\u011funu g\u00f6stermeye \u00e7al\u0131\u015facak ve bunun \u00f6zelikle de Alevilerin y\u00fczlerce y\u0131ld\u0131r ve halen temel ve g\u00fcncel bir sorunu olan soyk\u0131r\u0131m fiilleri y\u00f6n\u00fcnden ne t\u00fcr sak\u0131ncalar bar\u0131nd\u0131rd\u0131\u011f\u0131n\u0131 temel tart\u0131\u015fma konusu yapaca\u011f\u0131m. Bu arada \u0130BB taraf\u0131ndan bast\u0131r\u0131lan bro\u015f\u00fcre ili\u015fkin tart\u0131\u015fmalar\u0131n da bu bahisle do\u011frudan ilgili oldu\u011funu zannediyorum.<\/p>\n<p><strong>ALEV\u0130L\u0130K VE HUKUK<\/strong><\/p>\n<p>Alevilik ve Aleviler i\u00e7inde \u201chak\u201d bahsi -kimlik ve tan\u0131ma meselesini bir kenara b\u0131rak\u0131rsak- maalesef yeterince ilgi \u00e7ekmemi\u015ftir. \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesinin Alevili\u011fi di\u011fer dinlerle e\u015fit kimlik formunda resmetmesinin yaratt\u0131\u011f\u0131 tart\u0131\u015fma bile ne kadar haz\u0131rl\u0131ks\u0131z olundu\u011funu g\u00f6stermektedir. Bunun ba\u015fl\u0131ca sebeplerinden birisi \u201chak\u201d ve \u201chukuk\u201d ile ili\u015fkinin esas olarak \u201culus\u201d \u00fczerinden kurulmu\u015f olmas\u0131d\u0131r. Hak ile mezhep+din+yol aras\u0131ndaki ba\u011f\u0131 sadece ulus etnisite esasl\u0131 g\u00f6rmek esas\u0131nda burjuva siyasal k\u00fclt\u00fcr\u00fcn erken d\u00f6nemlerine has bir yakla\u015f\u0131md\u0131r. Maalesef Aleviler aras\u0131nda da yayg\u0131n oldu\u011fu g\u00f6r\u00fclmektedir. Etnik-k\u00fclt\u00fcrel-ulusal olan ile siyasal olan\u0131n \u00f6zde\u015fle\u015ftirildi\u011fi bu yakla\u015f\u0131m milliyet\u00e7i bir bak\u0131\u015f a\u00e7\u0131s\u0131yla \u201chak\u201dk\u0131 sadece kendi yaratt\u0131\u011f\u0131 bir \u201cmilli cemaate\u201d ait olarak g\u00f6rmek sonucunu do\u011furur. Gelnerr\u2019in \u201cmilli olan ile siyasal olan\u0131n \u00f6zde\u015fli\u011fi\u201d olarak tarif etti\u011fi milliyet\u00e7ilik ayn\u0131 zamanda \u201chukuki olan\u201d\u0131 da i\u00e7ine alan bir ideolojik yakla\u015f\u0131md\u0131r. Kant\u2019\u0131n deyi\u015fiyle bu \u201culusal \u00e7\u0131lg\u0131nl\u0131k\u201d \u201cyurt\u201d ile \u201cevrensel\u201d olan aras\u0131nda kurulabilecek farkl\u0131 \u201chak\u201d ba\u011flamlar\u0131n\u0131 maalesef yok etmi\u015ftir. Etnisite-siyaset ve hukukun bu i\u00e7i\u00e7e ge\u00e7i\u015fi modern fa\u015fizan hukuk devletlerinin de temel zeminini olu\u015fturur. \u0130\u015fte T\u00fcrkiye, \u201c\u00fcniterli\u011fi\u201d alg\u0131lama bi\u00e7imiyle tam b\u00f6yle bir hukuk k\u00fclt\u00fcr\u00fcn\u00fcn en keskin olarak ge\u00e7erli oldu\u011fu bir siyasal-hukuki co\u011frafyan\u0131n ad\u0131d\u0131r. Aleviler bu alg\u0131y\u0131 a\u015fmal\u0131d\u0131r.<\/p>\n<p><strong>HAK NEREDEN DO\u011eAR?<\/strong><\/p>\n<p>\u00c7\u00fcnk\u00fc ulus, etnisite, s\u0131n\u0131f, din, mezhep vb. gibi her nereden do\u011farsa do\u011fsun hak iddialar\u0131n\u0131n ger\u00e7ekli\u011fi ve ba\u015far\u0131s\u0131 hem g\u00fc\u00e7 ili\u015fkilerine hem de hegemonik iddialar\u0131na ba\u011fl\u0131 olmu\u015ftur. Nitekim Wilson ilkelerinden bu yana etnisite-ulus ve hak ili\u015fkisi giderek daha da demokratikle\u015fen bir geli\u015fme g\u00f6sterir. Uluslar\u0131n kendi kaderlerini tayin hakk\u0131n\u0131 tan\u0131nm\u0131\u015f \u201culus\u201d veya \u201cetnisite\u201dye hasretmek e\u011filimi k\u0131sa s\u00fcre sonra \u00f6rne\u011fin Lozan Antla\u015fmas\u0131\u2019nda da de\u011fi\u015fim g\u00f6stermi\u015ftir. Buna g\u00f6re Lozan\u2019da \u201cdinsel ve mezhepsel\u201d ayr\u0131mlar ile \u201cfarkl\u0131 dil\u201de ili\u015fkin bir hak kategorisi de tan\u0131nm\u0131\u015ft\u0131. Di\u011fer yandan uluslar\u0131n kendi kaderini tayin hakk\u0131n\u0131n sonraki kavramsalla\u015ft\u0131rmalar\u0131nda da -\u00f6rne\u011fin Lenin- \u201chak\u201dk\u0131n ulusu da a\u015fan hatta bir mahalleye ve bir aileye kadar ula\u015fan bir hak kurucu alan\u0131n \u00f6ne \u00e7\u0131kmaya ba\u015flad\u0131\u011f\u0131 g\u00f6r\u00fcl\u00fcr. B\u00f6ylece erken burjuva siyasal d\u00fc\u015f\u00fcncesinin hak, hukuk ve adalet bahsindeki milliyet\u00e7i tezler bizzat milliyet\u00e7ili\u011fin i\u00e7inde dahi giderek d\u00f6n\u00fc\u015f\u00fcme u\u011framaya ba\u015flam\u0131\u015ft\u0131r. Alevilik ve hukuk ba\u011flam\u0131ndaki bir di\u011fer sorun ise ulusu \u201chomojen\u201d buna kar\u015f\u0131l\u0131k din-mezhep-yolu heterojen olarak g\u00f6rmek ile alakal\u0131d\u0131r. Bu yakla\u015f\u0131m hem t\u0131pk\u0131 di\u011fer \u201ctopluluk\u201d halleri gibi milyonlarca farkl\u0131l\u0131k bar\u0131nd\u0131ran ulusu tek ve b\u00fct\u00fcnl\u00fckl\u00fc ger\u00e7ek ve somut bir yap\u0131 olarak zannetmekten kaynaklan\u0131r hem de hukuku sadece merkezi-resmi bir yap\u0131 ve mekanizma olarak anlamak sonucunu do\u011furur. B\u00f6ylece \u201chak\u201d kuruculuk iddias\u0131 birincisi sadece \u201cmillet\u201de ait hale gelmektedir. \u0130kincisi de hak ve hukuku geni\u015f toplumsal yap\u0131dan topluluklara ve oradan da yurtta\u015flara kadar uzanan kar\u015f\u0131l\u0131kl\u0131 ili\u015fkiler alan\u0131 olmaktan \u00e7\u0131kartmak sonucunu do\u011furur. E\u011fer Alevilik ve hukuk meselesine buradan bak\u0131l\u0131rsa son derece sorunlu bir tart\u0131\u015fma alan\u0131 ile kar\u015f\u0131 kar\u015f\u0131ya kal\u0131r\u0131z ve geleneksel s\u00f6ylemleri tekerlemelere d\u00f6n\u00fc\u015ft\u00fcrmekten ba\u015fka \u00e7are kalmaz.<\/p>\n<p><strong>ALEV\u0130L\u0130\u011e\u0130N B\u0130R CORPUS IURIUS CIVILIS\u2019\u0130 VAR MIDIR?<\/strong><\/p>\n<p>Di\u011fer yandan modern hukukun din d\u0131\u015f\u0131 sek\u00fcler karakterine yap\u0131lan vurgu da son derece i\u015flevsiz ve vukufiyetten yoksun bir bahis i\u00e7erir. Schmitt\u2019in yerinde olarak belirtti\u011fi \u00fczere ger\u00e7ekte modern egemenli\u011fe dair kavramlar \u201csek\u00fclerle\u015ftirilmi\u015f ilahi kavramlard\u0131r\u201d ve modern sek\u00fcler hukuka dair kavramlar\u0131n in\u015fa edildi\u011fi bir \u201chukuk\u00e7ular \u00e7a\u011f\u0131\u201d (the Age of lawyers) olarak 12. yy\u2019nin neredeyse b\u00fct\u00fcn kavramlar\u0131 dinsel ve modern hukuka ta\u015f\u0131yan yarat\u0131c\u0131lar\u0131 da \u201cdin adamlar\u0131\u201d idi. Al\u0131n size buradan hemen ger\u00e7ek bir Alevilik ve hukuk bahsi a\u00e7m\u0131\u015f olal\u0131m: Hakikat\u00e7ilerden \u201cAfe Ana ve hukuk\u201d ba\u015fl\u0131kl\u0131 bir \u00e7al\u0131\u015fma \u00f6devine ne dersiniz? Ba\u015fka deyi\u015fle hakikat\u00e7i gelenek i\u00e7inde \u201cadam\u201dlar\u0131n de\u011fil \u201ckad\u0131nlar\u0131n\u201d vaat etti\u011fi hukuk; hem modern hukukun \u201cortak ya\u015fam\u201d vaatlerine yeniden dahil olunabilecek bir ba\u011flam hem de cinsiyet e\u015fitsizli\u011fine dair en g\u00fcncel modern hukuk sorunlar\u0131na y\u00f6nelen bir tart\u0131\u015fman\u0131n k\u00f6klerine do\u011fru bir bilimsel ser\u00fcven vaat etmiyor mu? Veya bir Alevi \u201ccorpus iurius civilis\u201di bilimsel \u00e7al\u0131\u015fma i\u00e7in heyecan verici de\u011fil mi? Buradan bakt\u0131\u011f\u0131m\u0131zda hak bahsi ile ili\u015fkimiz memleketten gelen akrabalar\u0131 Luther ve Calvin\u2019in meydanlar\u0131nda, sokaklar\u0131nda gezdirmekten ibaret bir \u201cho\u015fg\u00f6r\u00fc\u201d ve \u201ctolerans\u201d ile s\u0131n\u0131rl\u0131ysa ku\u015fkusuz yapacak pek bir \u015fey yoktur ki bu halde kendi varolu\u015funuzu ve imkanlar\u0131n\u0131z\u0131 kendi s\u0131n\u0131rl\u0131 bilginize olan \u00f6zg\u00fcveniniz ile imha etmi\u015f olursunuz. \u00d6zet a\u00e7\u0131kt\u0131r: hak, hukuk ve adalet bahsi bak\u0131m\u0131ndan heterojen san\u0131lan din, mezhep, yol ile homojen san\u0131lan ulus-etnisite aras\u0131nda hiyerar\u015fik bir d\u00fczenek yoktur, politik bir ba\u011f vard\u0131r.<\/p>\n<p><strong>SORUNLU BA\u015eLANGI\u00c7LAR<\/strong><\/p>\n<p>\u015eimdi e\u011fer toparlar isek hak bahsinde heterojen alevilik ile homojen ulus kavram ve kurumlar\u0131n\u0131n birbirine kar\u0131\u015ft\u0131r\u0131lmas\u0131 iddias\u0131n\u0131n \u00fc\u00e7 \u00f6nemli sorunu oldu\u011funu s\u00f6yleyebiliriz. Birincisi \u201chak\u201dk\u0131 sadece ulus ve etnisiteye ba\u011flamak, ikincisi modern ulusa ait temel hukuksal kavramlar\u0131n \u201cdinsel\u201d ba\u011flamlar\u0131n\u0131 ala\u015fa\u011f\u0131 ederek gelenek ile olan s\u00fcreklilikleri g\u00f6zard\u0131 etmek ve \u00fc\u00e7\u00fcnc\u00fcs\u00fc ve bug\u00fcn a\u00e7\u0131s\u0131ndan politik g\u00fcncelli\u011fini ve aciliyetini koruyan nokta ise bu yakla\u015f\u0131m\u0131n Alevilerin T\u00fcrkiye\u2019deki varl\u0131\u011f\u0131n\u0131 ve yoklu\u011funu veya ba\u015fka deyi\u015fle imhas\u0131n\u0131 sadece toplumsal ve mezhepsel bir gerilimin i\u00e7ine yerle\u015ftirmek olarak g\u00f6sterilebilir. Birincisinde Alevili\u011fin hukuk ile ili\u015fkisi k\u0131s\u0131tlan\u0131yor ve ba\u015fkalar\u0131n\u0131n bilemeyece\u011fi g\u00fcl\u00fcn\u00e7 bir ezoterik dilde hapsediliyor. \u0130kincisinde Alevili\u011fin \u201cf\u0131k\u0131h\u201d\u0131 ve \u201cfukaha\u201ds\u0131 bug\u00fcne ula\u015fabilecek hukuki k\u00f6kenlerinden uzakla\u015ft\u0131r\u0131l\u0131yor \u00fc\u00e7\u00fcnc\u00fcs\u00fcnde ise Aleviler i\u00e7in as\u0131l d\u00fc\u015fman sadece I\u015e\u0130D, El Kaide ve Selefiler gibi unsurlar haline geliyor. Alevilerin k\u0131r\u0131m\u0131n\u0131n ve dahi soyk\u0131r\u0131m\u0131n\u0131n bizzat devlet ile, siyaset ve hukuk ile olan derin ba\u011f\u0131 g\u00f6zard\u0131 edilmi\u015f oluyor. \u015eimdi bir de Alevilik ve hukuk ba\u011flam\u0131ndaki en g\u00fcncel sorun olan soyk\u0131r\u0131m meselesine gelelim\u2026<\/p>\n<p><strong>ALEV\u0130L\u0130K VE SOYKIRIM<\/strong><\/p>\n<p>T\u00fcrkiye Alevili\u011finin hukuki-siyasi meselelerinin en \u00f6nemlilerinden biri veya birincisi soyk\u0131r\u0131m fiilleridir. Alevili\u011fin bu topraklardaki varl\u0131\u011f\u0131 ve yoklu\u011fu ile do\u011frudan ilgili olan bu konu bug\u00fcne kadar maalesef hukuken ve siyaseten bir sorumluluk alan\u0131na d\u00f6n\u00fc\u015ft\u00fcr\u00fclmemi\u015ftir. Oysa T\u00fcrkiye\u2019de bir yandan devletin ve kurumlar\u0131n S\u00fcnni \u0130slam temeline dayanmas\u0131 ile ayn\u0131 anda geni\u015f bir S\u00fcnni kitle \u015fiddetinin potansiyel olarak ve fiilen varl\u0131\u011f\u0131n\u0131 korumas\u0131 aras\u0131ndaki politik ve hukuki ba\u011f\u0131n a\u00e7\u0131\u011fa \u00e7\u0131kar\u0131lmas\u0131 ba\u015fl\u0131ca demokratik ve tabii ki hukuki g\u00f6revlerdendir. Cumhuriyetin ba\u015f\u0131ndan itibaren varl\u0131k ve \u00f6nemini koruyan bu sorun Cumhuriyetin \u201cdiyanet devleti\u201dnin bug\u00fcn AKP ile birlikte bir t\u00fcr \u201cRus devlet kilisesi\u201d benzeri bir yap\u0131ya d\u00f6n\u00fc\u015fmeye ba\u015flamas\u0131 nedeniyle \u00f6n\u00fcm\u00fczdeki s\u00fcre\u00e7leri daha da yak\u0131c\u0131 k\u0131lmaktad\u0131r. \u015eimdi buradan bakt\u0131\u011f\u0131m\u0131zda e\u011fer Alevilerin varl\u0131k ve yokluk sorununu I\u015e\u0130D ve benzeri Selefi yap\u0131lara veya \u0130hvan\u2019a ba\u011flarsan\u0131z T\u00fcrkiye\u2019de Alevilerin soyk\u0131r\u0131m alt\u0131nda olmad\u0131\u011f\u0131n\u0131, sadece bir toplumsal ve k\u00fclt\u00fcrel tehdit ile kar\u015f\u0131 kar\u015f\u0131ya oldu\u011funu iddia etmi\u015f olursunuz. Sorunun S\u00fcnni toplumsal \u015fiddet potansiyeli ve fiili oldu\u011funu savunmu\u015f olursunuz. Buradan bak\u0131ld\u0131\u011f\u0131nda \u00f6rne\u011fin Mara\u015f katliam\u0131n\u0131 anlamam\u0131z m\u00fcmk\u00fcn olmayacakt\u0131r. Alevi katliamlar\u0131n\u0131n hem devlet ve hem de toplumsal \u015fiddet ile bu \u015fekildeki bulu\u015fmas\u0131n\u0131n do\u011fru hukuki ele\u015ftirisinin yap\u0131lmas\u0131 ve buna ili\u015fkin bir ceza hukuku k\u00fcrs\u00fcs\u00fcn\u00fcn a\u00e7\u0131lmas\u0131 hem T\u00fcrkiye hukuk d\u00fczeninin temel karakteristi\u011fini hem de Alevili\u011fin T\u00fcrkiye\u2019nin hukuk d\u00fczeni i\u00e7inde nereye yerle\u015ftirildi\u011fini a\u00e7\u0131kl\u0131kla if\u015fa edecek niteliktedir. Alevilik ve hak bahsi a\u00e7\u0131s\u0131ndan en \u00f6nemli noktalardan birisi i\u015fte bu soyk\u0131r\u0131m sorunudur ve \u00fczerinde daha ciddiyetle d\u00fc\u015f\u00fcn\u00fclmeye ba\u015flanmal\u0131d\u0131r. Ayd\u0131n Ortaca Alevileri ile Malatya Alevilerini bir araya getirecek ortak bir hukuk m\u00fccadelesi \u00f6ncelikle buradan do\u011facakt\u0131r.<\/p>\n<p>Aleviler ile hak, hukuk ve adalet bahsinin ku\u015fkusuz ki soyk\u0131r\u0131m meselesini a\u015fan olduk\u00e7a geni\u015f bir alan\u0131 oldu\u011fu a\u00e7\u0131kt\u0131r: bir Alevi \u201cf\u0131k\u0131h\u201d\u0131ndan-bir Alevi \u201cfukaha\u201ds\u0131ndan (ku\u015fkusuz ki \u201cS\u00fcnnile\u015ftirilmi\u015f kavramlar\u201d yerine do\u011fru kavramlar bulunmal\u0131d\u0131r.) bir soyk\u0131r\u0131m ara\u015ft\u0131rmalar\u0131 alan\u0131na, bir Alevi \u201cCorpus Iurius Civilis\u201dinden (Medeni hukuk toplamalar\u0131) Alevili\u011fin ister g\u00fc\u00e7 ili\u015fkileri ba\u011flam\u0131ndaki ger\u00e7ek anayasac\u0131l\u0131k tarihindeki yerine isterse anayasal \u201cortak ya\u015fam\u201d (R\u0131za \u015eehri) tart\u0131\u015fmalar\u0131na kadar uzanan \u00e7ok \u00e7e\u015fitli \u00e7al\u0131\u015fma alanlar\u0131 \u00fczerine de ayr\u0131ca d\u00fc\u015f\u00fcnmek \u015fart.
