Anayasa Mahkemesi, Ayasofya’n\u0131n ibadete a\u00e7\u0131lmas\u0131 talebini i\u00e7eren bireysel ba\u015fvuruyu g\u00fcndemine ald\u0131. Y\u00fcksek Mahkeme ba\u015fvuruyu yar\u0131n karara ba\u011flayacak.<\/em><\/strong><\/p>\n

Ayasofya’n\u0131n ibadete a\u00e7\u0131lmas\u0131 i\u00e7in Anayasa Mahkemesi’ne bireysel ba\u015fvuru yap\u0131lm\u0131\u015ft\u0131.\u00a0 Ba\u015fvuru sahibi S\u00fcrekli Vak\u0131flar Tarihi Eserlere ve \u00c7evreye Hizmet Derne\u011fi.\u00a0S\u00f6z konusu dernek, 2004 y\u0131l\u0131nda Ba\u015fbakanl\u0131\u011fa ba\u015fvurarak, Ayasofya’da ibadet yap\u0131lmas\u0131na izin verilmesi konusunda yeni bir d\u00fczenleme yap\u0131lmas\u0131n\u0131 istedi. Ancak derne\u011fin bu ba\u015fvurusuna ba\u015fbakanl\u0131ktan yan\u0131t gelmedi.<\/p>\n

Bunun \u00fczerine dernek 2005 y\u0131l\u0131nda Bakanlar Kurulu’nun Ayasofya’n\u0131n m\u00fcze yap\u0131lmas\u0131na dair karar\u0131n\u0131n iptali i\u00e7in Dan\u0131\u015ftay’da dava a\u00e7t\u0131. Dan\u0131\u015ftay 10. Dairesi, derne\u011finin iptal talebini reddetti. Dernek bu karara kar\u015f\u0131 karar d\u00fczeltme ba\u015fvurusunda bulundu. Ancak Dan\u0131\u015ftay \u0130dari Dava Daireleri Kurulu da ba\u015fvurunun reddine kararla\u015ft\u0131rd\u0131.<\/p>\n

Bu geli\u015fme \u00fczerine dernek 2015 y\u0131l\u0131nda Anayasa Mahkemesi’ne bireysel ba\u015fvuruda bulundu. Ba\u015fvuru dilek\u00e7esinde Ayasofya’n\u0131n ibadete a\u00e7\u0131lmas\u0131 y\u00f6n\u00fcndeki talebin reddedilmesinin din ve vicdan h\u00fcrriyetini ihlal etti\u011fi belirtildi.<\/p>\n

Bas\u0131nda yer alan haberlere g\u00f6re AYM bu ba\u015fvuruyu 3 y\u0131l sonra g\u00fcndemine ald\u0131. Y\u00fcksek Mahkeme yar\u0131n (13 Eyl\u00fcl Per\u015fembe) yapaca\u011f\u0131 toplant\u0131da derne\u011fin ba\u015fvurusuna dair karar\u0131n\u0131 verecek. Y\u00fcksek Mahkeme’nin verece\u011fi karar Ayasofya’n\u0131n gelece\u011fine etki edecek.<\/p>\n
